| 7 | 7 | | relating to the use of certain drugs in breeding stock by or on the |

| 8 | 8 | | prescription of a veterinarian. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter H, Chapter 801, Occupations Code, is |
|---|
| 11 | 11 | | amended by adding Section 801.365 to read as follows: |
|---|
| 12 | 12 | | Sec. 801.365. BREEDING STOCK. (a) In this section, |
|---|
| 13 | 13 | | "breeding stock" means an animal: |
|---|
| 14 | 14 | | (1) intended by its owner or caretaker, with the input |
|---|
| 15 | 15 | | of a veterinarian, to be used for selective mating to maintain or |
|---|
| 16 | 16 | | enhance desirable genetic traits, including growth rate and yield |
|---|
| 17 | 17 | | of products such as eggs, milk, or meat, in future generations; and |
|---|
| 18 | 18 | | (2) not intended for human or animal consumption. |
|---|
| 19 | 19 | | (b) A veterinarian may administer, prescribe, dispense, or |
|---|
| 20 | 20 | | deliver any drug for off-label use in breeding stock. |
|---|
| 21 | 21 | | (c) An owner or caretaker may use a drug described by |
|---|
| 22 | 22 | | Subsection (b) in breeding stock in the manner prescribed by a |
|---|
| 23 | 23 | | veterinarian. |

| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2019. |
