55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of certain drugs in breeding stock by or on the
88 prescription of a veterinarian.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter H, Chapter 801, Occupations Code, is
1111 amended by adding Section 801.365 to read as follows:
1212 Sec. 801.365. BREEDING STOCK. (a) In this section,
1313 "breeding stock" means an animal:
1414 (1) intended by its owner or caretaker, with the input
1515 of a veterinarian, to be used for selective mating to maintain or
1616 enhance desirable genetic traits, including growth rate and yield
1717 of products such as eggs, milk, or meat, in future generations; and
1818 (2) not intended for human or animal consumption.
1919 (b) A veterinarian may administer, prescribe, dispense, or
2020 deliver any drug for off-label use in breeding stock.
2121 (c) An owner or caretaker may use a drug described by
2222 Subsection (b) in breeding stock in the manner prescribed by a
2323 veterinarian.
2424 SECTION 2. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2019.
