55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study on issues regarding service animals.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. (a) In this section:
1010 (1) "Commission" means the Health and Human Services
1111 Commission.
1212 (2) "Service animal" means an animal that is specially
1313 trained to perform tasks for a person with a disability or otherwise
1414 assist the person with the activities of daily living.
1515 (b) The commission shall conduct a study on issues regarding
1616 service animals. In conducting the study, the commission may
1717 collaborate with and seek input from other appropriate state
1818 agencies, local governmental entities, and advocacy groups for
1919 persons with disabilities.
2020 (c) The study must identify:
2121 (1) the types of animals that can be trained as service
2222 animals and the types of animals that are defined as service animals
2323 under state and federal laws;
2424 (2) the types of tasks a service animal can perform for
2525 and other assistance the animal can provide to a person with a
2626 disability, each categorized according to disability and type of
2727 animal;
2828 (3) the unique types of tasks a service animal can
2929 perform for and other assistance the animal can provide to a
3030 veteran;
3131 (4) existing state laws that address a person who
3232 falsely identifies an animal as a service animal and proposed state
3333 laws and policies designed to prevent that false identification;
3434 (5) methods to prevent the fraudulent sale of an
3535 animal as a service animal or the sale of an animal as a service
3636 animal with a claimed level of or claimed specialized training that
3737 the animal does not have;
3838 (6) methods to prevent other types of fraud concerning
3939 the provision of a service animal to a veteran;
4040 (7) existing service animal training programs that
4141 certify an animal as a service animal;
4242 (8) the best methods for licensing or certifying an
4343 animal as a service animal; and
4444 (9) any other issues relating to the training,
4545 certification, identification, provision, or use of, or tasks
4646 performed or other assistance provided by, a service animal.
4747 (d) Not later than November 1, 2020, the commission shall
4848 submit a written report on the findings of the study to the standing
4949 committees of the senate and house of representatives having
5050 jurisdiction over health and human services. The report must
5151 include recommendations for policy and statutory changes,
5252 including any proposed legislation, that are based on the results
5353 of the study.
5454 SECTION 2. This Act takes effect September 1, 2019.
