77 relating to the precedence of election contests in district and
88 appellate courts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 231.009, Election Code, is amended to
1111 read as follows:
1212 Sec. 231.009. PRECEDENCE OF ELECTION CONTEST [ON APPEAL].
1313 An election contest has precedence in the district and appellate
1414 courts and shall be disposed of as expeditiously as practicable. A
1515 court must to the extent reasonably possible ensure that the action
1616 is brought to final disposition before the expiration of the term of
1717 the contested office.
1818 SECTION 2. The change in law made by this Act applies only
1919 to an election contest filed on or after the effective date of this
2020 Act. An election contest filed before the effective date of this Act
2121 is governed by the law as it existed immediately before the
2222 effective date of this Act, and that law is continued in effect for
2323 that purpose.
2424 SECTION 3. This Act takes effect September 1, 2019.
