55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requiring that human sexuality instruction in public
88 schools be approved by the State Board of Education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 28.004(e), Education Code, is amended to
1111 read as follows:
1212 (e) Any course materials and instruction relating to human
1313 sexuality, sexually transmitted diseases, or human
1414 immunodeficiency virus or acquired immune deficiency syndrome
1515 shall be selected by the board of trustees with the advice of the
1616 local school health advisory council and must:
1717 (1) present abstinence from sexual activity as the
1818 preferred choice of behavior in relationship to all sexual activity
1919 for unmarried persons of school age;
2020 (2) devote more attention to abstinence from sexual
2121 activity than to any other behavior;
2222 (3) emphasize that abstinence from sexual activity, if
2323 used consistently and correctly, is the only method that is 100
2424 percent effective in preventing pregnancy, sexually transmitted
2525 diseases, infection with human immunodeficiency virus or acquired
2626 immune deficiency syndrome, and the emotional trauma associated
2727 with adolescent sexual activity;
2828 (4) direct adolescents to a standard of behavior in
2929 which abstinence from sexual activity before marriage is the most
3030 effective way to prevent pregnancy, sexually transmitted diseases,
3131 and infection with human immunodeficiency virus or acquired immune
3232 deficiency syndrome; [and]
3333 (5) teach contraception and condom use in terms of
3434 human use reality rates instead of theoretical laboratory rates, if
3535 instruction on contraception and condoms is included in curriculum
3636 content; and
3737 (6) be approved by the State Board of Education.
3838 SECTION 2. This Act applies beginning with the 2019-2020
3939 school year.
4040 SECTION 3. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2019.
