| 7 | 7 | | relating to requiring that human sexuality instruction in public |
|---|
| 8 | 8 | | schools be approved by the State Board of Education. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 28.004(e), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (e) Any course materials and instruction relating to human |
|---|
| 13 | 13 | | sexuality, sexually transmitted diseases, or human |
|---|
| 14 | 14 | | immunodeficiency virus or acquired immune deficiency syndrome |
|---|
| 15 | 15 | | shall be selected by the board of trustees with the advice of the |
|---|
| 16 | 16 | | local school health advisory council and must: |
|---|
| 17 | 17 | | (1) present abstinence from sexual activity as the |
|---|
| 18 | 18 | | preferred choice of behavior in relationship to all sexual activity |
|---|
| 19 | 19 | | for unmarried persons of school age; |
|---|
| 20 | 20 | | (2) devote more attention to abstinence from sexual |
|---|
| 21 | 21 | | activity than to any other behavior; |
|---|
| 22 | 22 | | (3) emphasize that abstinence from sexual activity, if |
|---|
| 23 | 23 | | used consistently and correctly, is the only method that is 100 |
|---|
| 24 | 24 | | percent effective in preventing pregnancy, sexually transmitted |
|---|
| 25 | 25 | | diseases, infection with human immunodeficiency virus or acquired |
|---|
| 26 | 26 | | immune deficiency syndrome, and the emotional trauma associated |
|---|
| 27 | 27 | | with adolescent sexual activity; |
|---|
| 28 | 28 | | (4) direct adolescents to a standard of behavior in |
|---|
| 29 | 29 | | which abstinence from sexual activity before marriage is the most |
|---|
| 30 | 30 | | effective way to prevent pregnancy, sexually transmitted diseases, |
|---|
| 31 | 31 | | and infection with human immunodeficiency virus or acquired immune |
|---|
| 32 | 32 | | deficiency syndrome; [and] |
|---|
| 33 | 33 | | (5) teach contraception and condom use in terms of |
|---|
| 34 | 34 | | human use reality rates instead of theoretical laboratory rates, if |
|---|
| 35 | 35 | | instruction on contraception and condoms is included in curriculum |
|---|
| 36 | 36 | | content; and |
|---|
| 37 | 37 | | (6) be approved by the State Board of Education. |
|---|
| 38 | 38 | | SECTION 2. This Act applies beginning with the 2019-2020 |
|---|
| 39 | 39 | | school year. |
|---|
| 40 | 40 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 44 | 44 | | Act takes effect September 1, 2019. |
