| 8 | 8 | | school district employee compensation and employment contracts and |
|---|
| 9 | 9 | | to the term of a contract for a teacher and a superintendent of a |
|---|
| 10 | 10 | | school district. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter D, Chapter 11, Education Code, is |
|---|
| 13 | 13 | | amended by adding Section 11.1519 to read as follows: |
|---|
| 14 | 14 | | Sec. 11.1519. POSTING OF DISTRICT EMPLOYEE COMPENSATION AND |
|---|
| 15 | 15 | | CONTRACT INFORMATION. (a) In this section, "compensation" means |
|---|
| 16 | 16 | | salaries, wages, and employment stipends. |
|---|
| 17 | 17 | | (b) Not later than the 30th day after the date the agency |
|---|
| 18 | 18 | | posts the information submitted by the district under the Public |
|---|
| 19 | 19 | | Education Information Management System (PEIMS), a school district |
|---|
| 20 | 20 | | that maintains an Internet website shall post on the district's |
|---|
| 21 | 21 | | website: |
|---|
| 22 | 22 | | (1) a listing of each district employee and the |
|---|
| 23 | 23 | | employee's compensation for the school year; |
|---|
| 24 | 24 | | (2) subject to Subsection (d), a copy of a contract |
|---|
| 25 | 25 | | signed by: |
|---|
| 26 | 26 | | (A) the district's superintendent; |
|---|
| 27 | 27 | | (B) an athletic director; and |
|---|
| 28 | 28 | | (C) each coach of any extracurricular athletic |
|---|
| 29 | 29 | | activity employed by the district; and |
|---|
| 30 | 30 | | (3) a blank copy of each type of contract used by the |
|---|
| 31 | 31 | | district under Section 21.002(a). |
|---|
| 32 | 32 | | (c) If a school district does not maintain an Internet |
|---|
| 33 | 33 | | website, the district shall submit the information required by |
|---|
| 34 | 34 | | Subsection (b) to the agency within the period provided by that |
|---|
| 35 | 35 | | subsection. On receipt of the information submitted under this |
|---|
| 36 | 36 | | subsection, the agency shall post the district's information on the |
|---|
| 37 | 37 | | agency's Internet website. |
|---|
| 38 | 38 | | (d) A copy of a contract described by Subsection (b)(2) that |
|---|
| 39 | 39 | | is posted on an Internet website under that subsection or |
|---|
| 40 | 40 | | Subsection (c) must be redacted to exclude any information that is |
|---|
| 41 | 41 | | confidential under Chapter 552, Government Code. |
|---|
| 42 | 42 | | (e) Information posted on an Internet website by a school |
|---|
| 43 | 43 | | district or the agency as required by this section must be |
|---|
| 44 | 44 | | maintained on that website until the applicable entity posts the |
|---|
| 45 | 45 | | information for the following school year. |
|---|
| 46 | 46 | | (f) The commissioner may adopt rules as necessary to |
|---|
| 47 | 47 | | implement this section. |
|---|
| 48 | 48 | | SECTION 2. Section 11.201(b), Education Code, is amended to |
|---|
| 49 | 49 | | read as follows: |
|---|
| 50 | 50 | | (b) The board of trustees of an independent school district |
|---|
| 51 | 51 | | may employ by contract a superintendent for a term not to exceed the |
|---|
| 52 | 52 | | length of the term of a trustee of the district [five years]. |
|---|
| 53 | 53 | | SECTION 3. Section 21.205, Education Code, is amended to |
|---|
| 54 | 54 | | read as follows: |
|---|
| 55 | 55 | | Sec. 21.205. TERM OF CONTRACT. Except as provided by |
|---|
| 56 | 56 | | Section 11.201(b), once [Once] a teacher has completed the |
|---|
| 57 | 57 | | probationary contract period, the term of a contract under this |
|---|
| 58 | 58 | | subchapter may not exceed five school years. |
|---|
| 59 | 59 | | SECTION 4. Section 21.206, Education Code, is amended by |
|---|
| 60 | 60 | | adding Subsection (d) to read as follows: |
|---|
| 61 | 61 | | (d) The board of trustees may not renew a teacher's term |
|---|
| 62 | 62 | | contract earlier than the sixth month before the contract ends. |
|---|
| 63 | 63 | | SECTION 5. Section 21.212, Education Code, is amended by |
|---|
| 64 | 64 | | adding Subsection (g) to read as follows: |
|---|
| 65 | 65 | | (g) The board of trustees may not renew a superintendent's |
|---|
| 66 | 66 | | term contract earlier than the sixth month before the contract |
|---|
| 67 | 67 | | ends. |
|---|
| 68 | 68 | | SECTION 6. Section 11.201(b), Education Code, as amended by |
|---|
| 69 | 69 | | this Act, and Sections 21.206(d) and 21.212(g), Education Code, as |
|---|
| 70 | 70 | | added by this Act, apply only to a contract executed on or after the |
|---|
| 71 | 71 | | effective date of this Act. A contract executed before the |
|---|
| 72 | 72 | | effective date of this Act is governed by the law in effect on the |
|---|
| 73 | 73 | | date the contract was executed, and the former law is continued in |
|---|
| 74 | 74 | | effect for that purpose. |
|---|
| 75 | 75 | | SECTION 7. This Act takes effect immediately if it receives |
|---|
| 76 | 76 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 77 | 77 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 78 | 78 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 79 | 79 | | Act takes effect September 1, 2019. |
