55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the availability of certain information regarding
88 school district employee compensation and employment contracts and
99 to the term of a contract for a teacher and a superintendent of a
1010 school district.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter D, Chapter 11, Education Code, is
1313 amended by adding Section 11.1519 to read as follows:
1414 Sec. 11.1519. POSTING OF DISTRICT EMPLOYEE COMPENSATION AND
1515 CONTRACT INFORMATION. (a) In this section, "compensation" means
1616 salaries, wages, and employment stipends.
1717 (b) Not later than the 30th day after the date the agency
1818 posts the information submitted by the district under the Public
1919 Education Information Management System (PEIMS), a school district
2020 that maintains an Internet website shall post on the district's
2121 website:
2222 (1) a listing of each district employee and the
2323 employee's compensation for the school year;
2424 (2) subject to Subsection (d), a copy of a contract
2525 signed by:
2626 (A) the district's superintendent;
2727 (B) an athletic director; and
2828 (C) each coach of any extracurricular athletic
2929 activity employed by the district; and
3030 (3) a blank copy of each type of contract used by the
3131 district under Section 21.002(a).
3232 (c) If a school district does not maintain an Internet
3333 website, the district shall submit the information required by
3434 Subsection (b) to the agency within the period provided by that
3535 subsection. On receipt of the information submitted under this
3636 subsection, the agency shall post the district's information on the
3737 agency's Internet website.
3838 (d) A copy of a contract described by Subsection (b)(2) that
3939 is posted on an Internet website under that subsection or
4040 Subsection (c) must be redacted to exclude any information that is
4141 confidential under Chapter 552, Government Code.
4242 (e) Information posted on an Internet website by a school
4343 district or the agency as required by this section must be
4444 maintained on that website until the applicable entity posts the
4545 information for the following school year.
4646 (f) The commissioner may adopt rules as necessary to
4747 implement this section.
4848 SECTION 2. Section 11.201(b), Education Code, is amended to
4949 read as follows:
5050 (b) The board of trustees of an independent school district
5151 may employ by contract a superintendent for a term not to exceed the
5252 length of the term of a trustee of the district [five years].
5353 SECTION 3. Section 21.205, Education Code, is amended to
5454 read as follows:
5555 Sec. 21.205. TERM OF CONTRACT. Except as provided by
5656 Section 11.201(b), once [Once] a teacher has completed the
5757 probationary contract period, the term of a contract under this
5858 subchapter may not exceed five school years.
5959 SECTION 4. Section 21.206, Education Code, is amended by
6060 adding Subsection (d) to read as follows:
6161 (d) The board of trustees may not renew a teacher's term
6262 contract earlier than the sixth month before the contract ends.
6363 SECTION 5. Section 21.212, Education Code, is amended by
6464 adding Subsection (g) to read as follows:
6565 (g) The board of trustees may not renew a superintendent's
6666 term contract earlier than the sixth month before the contract
6767 ends.
6868 SECTION 6. Section 11.201(b), Education Code, as amended by
6969 this Act, and Sections 21.206(d) and 21.212(g), Education Code, as
7070 added by this Act, apply only to a contract executed on or after the
7171 effective date of this Act. A contract executed before the
7272 effective date of this Act is governed by the law in effect on the
7373 date the contract was executed, and the former law is continued in
7474 effect for that purpose.
7575 SECTION 7. This Act takes effect immediately if it receives
7676 a vote of two-thirds of all the members elected to each house, as
7777 provided by Section 39, Article III, Texas Constitution. If this
7878 Act does not receive the vote necessary for immediate effect, this
7979 Act takes effect September 1, 2019.
