5+ A BILL TO BE ENTITLED
46 AN ACT
57 relating to the authority of an owner of real property sold at a tax
68 sale to transfer the owner's right of redemption to another person.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 34.21, Tax Code, is amended by adding
911 Subsection (l) to read as follows:
1012 (l) An owner of real property who is entitled to redeem the
1113 property under this section may not transfer the owner's right of
1214 redemption to another person. Any instrument purporting to
1315 transfer the owner's right of redemption is void.
1416 SECTION 2. The change in law made by this Act does not
1517 affect a transfer of a property owner's right of redemption that
1618 occurred before the effective date of this Act.
1719 SECTION 3. This Act takes effect immediately if it receives
1820 a vote of two-thirds of all the members elected to each house, as
1921 provided by Section 39, Article III, Texas Constitution. If this
2022 Act does not receive the vote necessary for immediate effect, this
2123 Act takes effect September 1, 2019.
