55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to eligibility of certain students for Foundation School
88 Program benefits and the calculation of average daily attendance
99 for those students.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 42.003(a), Education Code, is amended to
1212 read as follows:
1313 (a) A student is entitled to the benefits of the Foundation
1414 School Program if, on September 1 of the school year, the student:
1515 (1) is 5 years of age or older and under 21 years of age
1616 and has not graduated from high school, or is at least 21 years of
1717 age and under 26 years of age and has been admitted by a school
1818 district to complete the requirements for a high school diploma;
1919 [or]
2020 (2) is at least 19 years of age and under 26 years of
2121 age and is enrolled in an adult high school diploma and industry
2222 certification charter school pilot program under Section 29.259; or
2323 (3) is at least 18 years of age and under 26 years of
2424 age and is enrolled in a workforce training program provided by a
2525 school district off campus.
2626 SECTION 2. Section 42.005, Education Code, is amended by
2727 adding Subsection (h-1) to read as follows:
2828 (h-1) For a student described by Section 42.003(a)(3), time
2929 that the student spends participating in a program under that
3030 subdivision shall be counted as part of the minimum number of
3131 instructional hours required for a student to be considered a
3232 full-time student in average daily attendance for purposes of this
3333 section.
3434 SECTION 3. This Act takes effect September 1, 2019.
