| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 42.003(a), Education Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (a) A student is entitled to the benefits of the Foundation |
|---|
| 14 | 14 | | School Program if, on September 1 of the school year, the student: |
|---|
| 15 | 15 | | (1) is 5 years of age or older and under 21 years of age |
|---|
| 16 | 16 | | and has not graduated from high school, or is at least 21 years of |
|---|
| 17 | 17 | | age and under 26 years of age and has been admitted by a school |
|---|
| 18 | 18 | | district to complete the requirements for a high school diploma; |
|---|
| 19 | 19 | | [or] |
|---|
| 20 | 20 | | (2) is at least 19 years of age and under 26 years of |
|---|
| 21 | 21 | | age and is enrolled in an adult high school diploma and industry |
|---|
| 22 | 22 | | certification charter school pilot program under Section 29.259; or |
|---|
| 23 | 23 | | (3) is at least 18 years of age and under 26 years of |
|---|
| 24 | 24 | | age and is enrolled in a workforce training program provided by a |
|---|
| 25 | 25 | | school district off campus. |

| 26 | 26 | | SECTION 2. Section 42.005, Education Code, is amended by |
|---|
| 27 | 27 | | adding Subsection (h-1) to read as follows: |
|---|
| 28 | 28 | | (h-1) For a student described by Section 42.003(a)(3), time |
|---|
| 29 | 29 | | that the student spends participating in a program under that |
|---|
| 30 | 30 | | subdivision shall be counted as part of the minimum number of |
|---|
| 31 | 31 | | instructional hours required for a student to be considered a |
|---|
| 32 | 32 | | full-time student in average daily attendance for purposes of this |
|---|
| 33 | 33 | | section. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2019. |
