55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of pharmacy services through a
88 telepharmacy system.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 562.110(e), Occupations Code, is amended
1111 to read as follows:
1212 (e) The board shall adopt rules regarding the use of a
1313 telepharmacy system under this section, including:
1414 (1) the types of health care facilities at which a
1515 telepharmacy system may be located under Subsection (d)(1), which
1616 must include the following facilities:
1717 (A) a clinic designated as a rural health clinic
1818 regulated under 42 U.S.C. Section 1395x(aa); [and]
1919 (B) a health center as defined by 42 U.S.C.
2020 Section 254b;
2121 (C) a federally qualified health center as
2222 defined by 42 U.S.C. Section 1396d(l)(2)(B);
2323 (D) an ambulatory surgical center;
2424 (E) a birthing center;
2525 (F) a community health center;
2626 (G) a hospital;
2727 (H) an outpatient clinic; and
2828 (I) a public health clinic;
2929 (2) the locations eligible to be licensed as remote
3030 dispensing sites, which must include locations in medically
3131 underserved areas, areas with a medically underserved population,
3232 and health professional shortage areas determined by the United
3333 States Department of Health and Human Services;
3434 (3) licensing and operating requirements for remote
3535 dispensing sites, including:
3636 (A) a requirement that a remote dispensing site
3737 license identify the provider pharmacy that will provide pharmacy
3838 services at the remote dispensing site;
3939 (B) a requirement that a provider pharmacy be
4040 allowed to provide pharmacy services at not more than two remote
4141 dispensing sites;
4242 (C) a requirement that a pharmacist employed by a
4343 provider pharmacy make at least monthly on-site visits to a remote
4444 dispensing site or more frequent visits if specified by board rule;
4545 (D) a requirement that each month the perpetual
4646 inventory of controlled substances at the remote dispensing site be
4747 reconciled to the on-hand count of those controlled substances at
4848 the site by a pharmacist employed by the provider pharmacy;
4949 (E) a requirement that a pharmacist employed by a
5050 provider pharmacy be physically present at a remote dispensing site
5151 when the pharmacist is providing services requiring the physical
5252 presence of the pharmacist, including immunizations;
5353 (F) a requirement that a remote dispensing site
5454 be staffed by an on-site pharmacy technician who is under the
5555 continuous supervision of a pharmacist employed by the provider
5656 pharmacy;
5757 (G) a requirement that all pharmacy technicians
5858 at a remote dispensing site be counted for the purpose of
5959 establishing the pharmacist-pharmacy technician ratio of the
6060 provider pharmacy, which, notwithstanding Section 568.006, may not
6161 exceed three pharmacy technicians for each pharmacist providing
6262 supervision;
6363 (H) a requirement that, before working at a
6464 remote dispensing site, a pharmacy technician must:
6565 (i) have worked at least one year at a
6666 retail pharmacy during the three years preceding the date the
6767 pharmacy technician begins working at the remote dispensing site;
6868 and
6969 (ii) have completed a board-approved
7070 training program on the proper use of a telepharmacy system;
7171 (I) a requirement that pharmacy technicians at a
7272 remote dispensing site may not perform extemporaneous sterile or
7373 nonsterile compounding but may prepare commercially available
7474 medications for dispensing, including the reconstitution of orally
7575 administered powder antibiotics; and
7676 (J) any additional training or practice
7777 experience requirements for pharmacy technicians at a remote
7878 dispensing site;
7979 (4) the areas that qualify under Subsection (f);
8080 (5) recordkeeping requirements; and
8181 (6) security requirements.
8282 SECTION 2. Sections 562.110(g), (h), and (i) Occupations
8383 Code, as added by Chapter 485 (H.B. 2561), Acts of the 85th
8484 Legislature, Regular Session, 2017, are repealed.
8585 SECTION 3. This Act takes effect September 1, 2019.
