| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter C, Chapter 552, Government Code, is | |
| 11 | 11 | amended by adding Section 552.159 to read as follows: | |
| 12 | 12 | Sec. 552.159. EXCEPTION: CONFIDENTIALITY OF CERTAIN | |
| 13 | 13 | INFORMATION RELATED TO SUITABILITY OF APPLICANT TO BE PEACE OFFICER | |
| 14 | 14 | OR FIREFIGHTER. Information maintained by a governmental body that | |
| 15 | 15 | relates to a background investigation of an applicant for a peace | |
| 16 | 16 | officer or firefighter position with the governmental body is | |
| 17 | 17 | confidential and excepted from the requirements of Section 552.021 | |
| 18 | 18 | if the information: | |
| 19 | 19 | (1) is obtained from another person; and | |
| 20 | 20 | (2) concerns the character or suitability of the | |
| 21 | 21 | applicant to be a peace officer or firefighter. | |
| 22 | 22 | SECTION 2. The changes in law made by this Act apply only to | |
| 23 | 23 | a request for information that is received by a governmental body or | |
| 24 | 24 | an officer for public information on or after the effective date of | |
| 25 | 25 | this Act. A request for information that was received before the | |
| 26 | 26 | effective date of this Act is governed by the law in effect on the | |
| 27 | 27 | date the request was received, and the former law is continued in | |
| 28 | 28 | effect for that purpose. | |
| 29 | 29 | SECTION 3. This Act takes effect September 1, 2019. |
