| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter E, Chapter 54, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 54.5192 to read as follows: |
|---|
| 12 | 12 | | Sec. 54.5192. INTERCOLLEGIATE ATHLETICS FEE; UNIVERSITY OF |
|---|
| 13 | 13 | | NORTH TEXAS AT DALLAS. (a) The board of regents of the University |
|---|
| 14 | 14 | | of North Texas System may charge each student enrolled at the |
|---|
| 15 | 15 | | University of North Texas at Dallas an intercollegiate athletics |
|---|
| 16 | 16 | | fee in an initial amount not to exceed $10 per semester credit hour |
|---|
| 17 | 17 | | for each semester or summer session. The amount of the fee may be |
|---|
| 18 | 18 | | increased only as provided by Subsection (e). |
|---|
| 19 | 19 | | (b) A student enrolled in more than 12 semester credit hours |
|---|
| 20 | 20 | | shall pay the fee in an amount equal to the amount charged a student |
|---|
| 21 | 21 | | enrolled in 12 semester credit hours during the same semester or |
|---|
| 22 | 22 | | session. |
|---|
| 23 | 23 | | (c) Revenue from the fee charged under this section may be |
|---|
| 24 | 24 | | used only for financing, constructing, operating, maintaining, or |
|---|
| 25 | 25 | | improving an athletic facility or for operating an intercollegiate |
|---|
| 26 | 26 | | athletics program at the university. |
|---|
| 27 | 27 | | (d) The fee may not be charged unless approved by a majority |
|---|
| 28 | 28 | | vote of the students enrolled at the university who participate in a |
|---|
| 29 | 29 | | general student election held for that purpose. The ballot for the |
|---|
| 30 | 30 | | election to approve the fee must state a maximum amount of the fee |
|---|
| 31 | 31 | | that may be charged per semester credit hour, not to exceed the |
|---|
| 32 | 32 | | maximum amount prescribed by Subsection (a). |
|---|
| 33 | 33 | | (e) The amount of the fee per semester credit hour may be |
|---|
| 34 | 34 | | increased from one academic year to the next only if approved by a |
|---|
| 35 | 35 | | majority vote of the students participating in a general student |
|---|
| 36 | 36 | | election held for that purpose or, if the amount of the increase |
|---|
| 37 | 37 | | does not exceed five percent, by a majority vote of the legislative |
|---|
| 38 | 38 | | body of the student government of the university. |
|---|
| 39 | 39 | | (f) The chief fiscal officer of the university shall collect |
|---|
| 40 | 40 | | the fee and shall deposit the revenue from the fee in an account to |
|---|
| 41 | 41 | | be known as the intercollegiate athletics fee account. |
|---|
| 42 | 42 | | (g) A fee charged under this section is in addition to any |
|---|
| 43 | 43 | | other fee authorized by law and may not be considered in determining |
|---|
| 44 | 44 | | the maximum amount of student services fees that may be charged each |
|---|
| 45 | 45 | | student enrolled at the university under Section 54.503. |
|---|
| 46 | 46 | | SECTION 2. A fee may not be charged under Section 54.5192, |
|---|
| 47 | 47 | | Education Code, as added by this Act, before the 2020 fall semester. |
|---|
| 48 | 48 | | SECTION 3. This Act takes effect September 1, 2019. |
