| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Section 61.222, Education Code, is amended by |
|---|
| 10 | 12 | | adding Subsection (d) to read as follows: |
|---|
| 11 | 13 | | (d) The coordinating board shall approve a private or |
|---|
| 12 | 14 | | independent institution of higher education as defined by Section |
|---|
| 13 | 15 | | 61.003 that previously qualified under Subsection (a) but no longer |
|---|
| 14 | 16 | | holds the same accreditation as public institutions of higher |
|---|
| 15 | 17 | | education. To qualify under this subsection, an institution must |
|---|
| 16 | 18 | | be: |
|---|
| 17 | 19 | | (1) accredited by an accreditor recognized by the |
|---|
| 18 | 20 | | board; |
|---|
| 19 | 21 | | (2) a work college, as that term is defined by 20 |
|---|
| 20 | 22 | | U.S.C. Section 1087-58; and |
|---|
| 21 | 23 | | (3) participating in the federal financial aid program |
|---|
| 22 | 24 | | under 20 U.S.C. Section 1070a. |
|---|
| 23 | 25 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 24 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 29 | | Act takes effect September 1, 2019. |
