 A BILL TO BE ENTITLED
 AN ACT
 relating to influenza information for residents of assisted living
 facilities.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 247.026, Health and Safety Code, is
 amended by adding Subsections (j) and (k) to read as follows:
 (j)  The executive commissioner shall require each assisted
 living facility to provide educational information regarding
 influenza to each resident of the facility not later than September
 1 of each year.  The educational information must include:
 (1)  the risks associated with influenza;
 (2)  the latest influenza vaccination recommendations
 of the Advisory Committee on Immunization Practices of the federal
 Centers for Disease Control and Prevention;
 (3)  the availability, effectiveness, and known
 contraindications of the influenza vaccine;
 (4)  the causes and symptoms of influenza; and
 (5)  the means by which influenza is spread.
 (k)  The executive commissioner may not require an assisted
 living facility to provide or pay for an influenza vaccination.
 SECTION 2.  This Act takes effect September 1, 2019.
