55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the punishment for the offense of forgery relating to a
88 writing of a metal recycling entity.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 32.21, Penal Code, is amended by
1111 amending Subsection (e-2) and adding Subsection (e-3) to read as
1212 follows:
1313 (e-2) Notwithstanding any other provision of this section,
1414 an offense under this section is a state jail felony if the writing
1515 is or purports to be a check, authorization to debit an account at a
1616 financial institution, or similar sight order issued by a metal
1717 recycling entity as defined by Section 1956.001, Occupations Code,
1818 regardless of the value of any property or service obtained or
1919 sought to be obtained.
2020 (e-3) Notwithstanding any other provision of this section,
2121 an offense under this section, other than an offense described for
2222 purposes of punishment by Subsection (e-1)(7) or (e-2), is
2323 increased to the next higher category of offense if it is shown on
2424 the trial of the offense that the offense was committed against an
2525 elderly individual as defined by Section 22.04.
2626 SECTION 2. The change in law made by this Act applies only
2727 to an offense committed on or after the effective date of this Act.
2828 An offense committed before the effective date of this Act is
2929 governed by the law in effect on the date the offense was committed,
3030 and the former law is continued in effect for that purpose. For
3131 purposes of this section, an offense was committed before the
3232 effective date of this Act if any element of the offense occurred
3333 before that date.
3434 SECTION 3. This Act takes effect September 1, 2019.
