55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the operation of unmanned aircraft over certain
88 facilities; creating a criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 423, Government Code, is amended by
1111 adding Section 423.0047 to read as follows:
1212 Sec. 423.0047. OFFENSE: OPERATION OF UNMANNED AIRCRAFT OVER
1313 OR NEAR SCHOOL. (a) In this section, "school" means any
1414 instructional or noninstructional facility owned or operated by:
1515 (1) a public or private elementary or secondary
1616 school; or
1717 (2) an institution of higher education or a private or
1818 independent institution of higher education, as those terms are
1919 defined by Section 61.003, Education Code.
2020 (b) A person commits an offense if the person intentionally
2121 or knowingly operates an unmanned aircraft over a school or within
2222 1,000 feet of the school.
2323 (c) This section does not apply to conduct described by
2424 Subsection (b) that is committed by:
2525 (1) the federal government, the state, or a
2626 governmental entity;
2727 (2) a person under contract with or otherwise acting
2828 under the direction or on behalf of the federal government, the
2929 state, or a governmental entity;
3030 (3) a law enforcement agency that provides to a school
3131 prior notice of the agency's operation of an unmanned aircraft over
3232 or near the school;
3333 (4) a person under contract with or otherwise acting
3434 under the direction or on behalf of a law enforcement agency that
3535 provides prior notice as described by Subdivision (3);
3636 (5) an operator of an unmanned aircraft that is being
3737 used for a commercial purpose, if the operation is conducted in
3838 compliance with:
3939 (A) each applicable Federal Aviation
4040 Administration rule, restriction, or exemption; and
4141 (B) all required Federal Aviation Administration
4242 authorizations;
4343 (6) a person under contract with or otherwise acting
4444 under the direction or on behalf of the governing body of the
4545 school; or
4646 (7) a person who has the prior written consent of the
4747 person who is primarily responsible for the security of the school.
4848 (d) An offense under this section is a Class B misdemeanor,
4949 except that the offense is a Class A misdemeanor if the actor has
5050 previously been convicted under this section or Section 423.0045 or
5151 423.0046.
5252 SECTION 2. Section 423.0045(d), Government Code, is amended
5353 to read as follows:
5454 (d) An offense under this section is a Class B misdemeanor,
5555 except that the offense is a Class A misdemeanor if the actor has
5656 previously been convicted under this section or Section 423.0046 or
5757 423.0047.
5858 SECTION 3. Section 423.0046(d), Government Code, is amended
5959 to read as follows:
6060 (d) An offense under this section is a Class B misdemeanor,
6161 except that the offense is a Class A misdemeanor if the actor has
6262 previously been convicted under this section or Section 423.0045 or
6363 423.0047.
6464 SECTION 4. The change in law made by this Act applies only
6565 to an offense committed on or after the effective date of this Act.
6666 An offense committed before the effective date of this Act is
6767 governed by the law in effect on the date the offense was committed,
6868 and the former law is continued in effect for that purpose. For
6969 purposes of this section, an offense was committed before the
7070 effective date of this Act if any element of the offense occurred
7171 before that date.
7272 SECTION 5. This Act takes effect September 1, 2019.
