46 AN ACT
57 relating to the powers and duties of the office of independent
68 ombudsman for the Texas Juvenile Justice Department.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 261.101, Human Resources Code, is
911 amended by adding Subsection (f) to read as follows:
1012 (f) Notwithstanding any other provision of this chapter,
1113 the powers of the office include:
1214 (1) the inspection of:
1315 (A) a facility operated by the department under
1416 Subtitle C;
1517 (B) a post-adjudication secure correctional
1618 facility under Section 51.125, Family Code;
1719 (C) a nonsecure correctional facility under
1820 Section 51.126, Family Code; and
1921 (D) any other residential facility in which a
2022 child adjudicated as having engaged in conduct indicating a need
2123 for supervision or delinquent conduct is placed by court order; and
2224 (2) the investigation of complaints alleging a
2325 violation of the rights of the children committed to or placed in a
2426 facility described by this subsection.
2527 SECTION 2. The following provisions of the Human Resources
2628 Code are repealed:
2729 (1) Section 261.101(e), as added by Section 11(b),
2830 Chapter 854 (S.B. 1149), Acts of the 84th Legislature, Regular
2931 Session, 2015; and
3032 (2) Section 261.101(e), as amended by Chapter 962
3133 (S.B. 1630), Acts of the 84th Legislature, Regular Session, 2015.
3234 SECTION 3. This Act takes effect September 1, 2019.
