55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the applicability of educator certification and
88 assignment requirements to school districts of innovation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 12A.004(a), Education Code, is amended
1111 to read as follows:
1212 (a) A local innovation plan may not provide for the
1313 exemption of a district designated as a district of innovation from
1414 the following provisions of this title:
1515 (1) a state or federal requirement applicable to an
1616 open-enrollment charter school operating under Subchapter D,
1717 Chapter 12;
1818 (2) Subchapters A, C, D, and E, Chapter 11, except that
1919 a district may be exempt from Sections 11.1511(b)(5) and (14) and
2020 Section 11.162;
2121 (3) educator certification requirements under Chapter
2222 21 for teachers assigned to teach subject areas included in the
2323 foundation curriculum under Section 28.002(a)(1);
2424 (4) state curriculum and graduation requirements
2525 adopted under Chapter 28; and
2626 (5) [(4)] academic and financial accountability and
2727 sanctions under Chapters 39 and 39A.
2828 SECTION 2. Section 12A.004(a), Education Code, as amended
2929 by this Act, applies only to a local innovation plan adopted or
3030 renewed on or after the effective date of this Act. A local
3131 innovation plan adopted or renewed before the effective date of
3232 this Act is governed by the law in effect on the date the plan was
3333 adopted or renewed, and the former law is continued in effect for
3434 that purpose.
3535 SECTION 3. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2019.
