66 AN ACT
77 relating to applicability of educator certification and class size
88 requirements to open-enrollment charter schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 12.104(b), Education Code, as amended by
1111 Chapters 324 (S.B. 1488), 522 (S.B. 179), and 735 (S.B. 1153), Acts
1212 of the 85th Legislature, Regular Session, 2017, is reenacted and
1313 amended to read as follows:
1414 (b) An open-enrollment charter school is subject to:
1515 (1) a provision of this title establishing a criminal
1616 offense; and
1717 (2) a prohibition, restriction, or requirement, as
1818 applicable, imposed by this title or a rule adopted under this
1919 title, relating to:
2020 (A) the Public Education Information Management
2121 System (PEIMS) to the extent necessary to monitor compliance with
2222 this subchapter as determined by the commissioner;
2323 (B) criminal history records under Subchapter C,
2424 Chapter 22;
2525 (C) reading instruments and accelerated reading
2626 instruction programs under Section 28.006;
2727 (D) accelerated instruction under Section
2828 28.0211;
2929 (E) high school graduation requirements under
3030 Section 28.025;
3131 (F) special education programs under Subchapter
3232 A, Chapter 29;
3333 (G) bilingual education under Subchapter B,
3434 Chapter 29;
3535 (H) prekindergarten programs under Subchapter E
3636 or E-1, Chapter 29;
3737 (I) extracurricular activities under Section
3838 33.081;
3939 (J) discipline management practices or behavior
4040 management techniques under Section 37.0021;
4141 (K) health and safety under Chapter 38;
4242 (L) public school accountability under
4343 Subchapters B, C, D, F, G, and J, Chapter 39, and Chapter 39A;
4444 (M) the requirement under Section 21.006 to
4545 report an educator's misconduct;
4646 (N) intensive programs of instruction under
4747 Section 28.0213;
4848 (O) the right of a school employee to report a
4949 crime, as provided by Section 37.148; [and]
5050 (P) bullying prevention policies and procedures
5151 under Section 37.0832;
5252 (Q) the right of a school under Section 37.0052
5353 to place a student who has engaged in certain bullying behavior in a
5454 disciplinary alternative education program or to expel the student;
5555 [and]
5656 (R) the right under Section 37.0151 to report to
5757 local law enforcement certain conduct constituting assault or
5858 harassment;
5959 (S) [(P)] a parent's right to information
6060 regarding the provision of assistance for learning difficulties to
6161 the parent's child as provided by Sections 26.004(b)(11) and
6262 26.0081(c) and (d);
6363 (T) educator certification requirements under
6464 Chapter 21; and
6565 (U) elementary class size limits under Section
6666 25.112.
6767 SECTION 2. To the extent of any conflict, this Act prevails
6868 over another Act of the 86th Legislature, Regular Session, 2019,
6969 relating to nonsubstantive additions to and corrections in enacted
7070 codes.
7171 SECTION 3. The change in law made by this Act applies only
7272 to a charter granted or renewed on or after the effective date of
7373 this Act. A charter granted or renewed before the effective date of
7474 this Act is governed by the law in effect on the date the charter was
7575 granted or renewed, and the former law is continued in effect for
7676 that purpose.
7777 SECTION 4. This Act applies beginning with the 2019-2020
7878 school year.
7979 SECTION 5. This Act takes effect immediately if it receives
8080 a vote of two-thirds of all the members elected to each house, as
8181 provided by Section 39, Article III, Texas Constitution. If this
8282 Act does not receive the vote necessary for immediate effect, this
8383 Act takes effect September 1, 2019.
