6	6	AN ACT
7	7	relating to applicability of educator certification and class size
8	8	requirements to open-enrollment charter schools.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 12.104(b), Education Code, as amended by
11	11	Chapters 324 (S.B. 1488), 522 (S.B. 179), and 735 (S.B. 1153), Acts
12	12	of the 85th Legislature, Regular Session, 2017, is reenacted and
13	13	amended to read as follows:
14	14	(b) An open-enrollment charter school is subject to:
15	15	(1) a provision of this title establishing a criminal
16	16	offense; and
17	17	(2) a prohibition, restriction, or requirement, as
18	18	applicable, imposed by this title or a rule adopted under this
19	19	title, relating to:
20	20	(A) the Public Education Information Management
21	21	System (PEIMS) to the extent necessary to monitor compliance with
22	22	this subchapter as determined by the commissioner;
23	23	(B) criminal history records under Subchapter C,
24	24	Chapter 22;
25	25	(C) reading instruments and accelerated reading
26	26	instruction programs under Section 28.006;
27	27	(D) accelerated instruction under Section
28	28	28.0211;
29	29	(E) high school graduation requirements under
30	30	Section 28.025;
31	31	(F) special education programs under Subchapter
32	32	A, Chapter 29;
33	33	(G) bilingual education under Subchapter B,
34	34	Chapter 29;
35	35	(H) prekindergarten programs under Subchapter E
36	36	or E-1, Chapter 29;
37	37	(I) extracurricular activities under Section
38	38	33.081;
39	39	(J) discipline management practices or behavior
40	40	management techniques under Section 37.0021;
41	41	(K) health and safety under Chapter 38;
42	42	(L) public school accountability under
43	43	Subchapters B, C, D, F, G, and J, Chapter 39, and Chapter 39A;
44	44	(M) the requirement under Section 21.006 to
45	45	report an educator's misconduct;
46	46	(N) intensive programs of instruction under
47	47	Section 28.0213;
48	48	(O) the right of a school employee to report a
49	49	crime, as provided by Section 37.148; [and]
50	50	(P) bullying prevention policies and procedures
51	51	under Section 37.0832;
52	52	(Q) the right of a school under Section 37.0052
53	53	to place a student who has engaged in certain bullying behavior in a
54	54	disciplinary alternative education program or to expel the student;
55	55	[and]
56	56	(R) the right under Section 37.0151 to report to
57	57	local law enforcement certain conduct constituting assault or
58	58	harassment;
59	59	(S) [(P)] a parent's right to information
60	60	regarding the provision of assistance for learning difficulties to
61	61	the parent's child as provided by Sections 26.004(b)(11) and
62	62	26.0081(c) and (d);
63	63	(T) educator certification requirements under
64	64	Chapter 21; and
65	65	(U) elementary class size limits under Section
66	66	25.112.
67	67	SECTION 2. To the extent of any conflict, this Act prevails
68	68	over another Act of the 86th Legislature, Regular Session, 2019,
69	69	relating to nonsubstantive additions to and corrections in enacted
70	70	codes.
71	71	SECTION 3. The change in law made by this Act applies only
72	72	to a charter granted or renewed on or after the effective date of
73	73	this Act. A charter granted or renewed before the effective date of
74	74	this Act is governed by the law in effect on the date the charter was
75	75	granted or renewed, and the former law is continued in effect for
76	76	that purpose.
77	77	SECTION 4. This Act applies beginning with the 2019-2020
78	78	school year.
79	79	SECTION 5. This Act takes effect immediately if it receives
80	80	a vote of two-thirds of all the members elected to each house, as
81	81	provided by Section 39, Article III, Texas Constitution. If this
82	82	Act does not receive the vote necessary for immediate effect, this
83	83	Act takes effect September 1, 2019.
