6	6	AN ACT
7	7	relating to a pilot program to provide additional funding to a
8	8	school district to improve the performance of certain campuses
9	9	under the accountability system.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Subchapter Z, Chapter 39A, Education Code, is
12	12	amended by adding Section 39A.907 to read as follows:
13	13	Sec. 39A.907. PILOT PROGRAM FOR ADDITIONAL STATE AID FOR
14	14	CAMPUS IMPROVEMENT. (a) The commissioner shall establish a campus
15	15	improvement pilot program in which a participating school district
16	16	with a campus that is assigned an overall performance rating of
17	17	needs improvement or unacceptable performance under Subchapter C,
18	18	Chapter 39, will receive additional state aid to implement a campus
19	19	improvement plan.
20	20	(b) The commissioner shall select not more than 12 school
21	21	districts in each state fiscal biennium to participate in the pilot
22	22	program. A district is eligible to apply to the commissioner to
23	23	participate in the program if:
24	24	(1) the district has a campus that is assigned an
25	25	overall performance rating under Subchapter C, Chapter 39, of needs
26	26	improvement or unacceptable performance;
27	27	(2) the district is located in a municipality or a
28	28	county with a high proportion of open-enrollment charter schools
29	29	relative to other municipalities or counties in this state, as
30	30	determined by the commissioner; and
31	31	(3) an open-enrollment charter school operating for
32	32	the first year is located in the boundaries of the district.
33	33	(c) A school district that meets the eligibility criteria
34	34	established under Subsection (b) and commissioner rules adopted
35	35	under this section may apply to the commissioner for selection to
36	36	participate in the pilot program. To be selected, the district must
37	37	submit a campus improvement plan as described by Section 11.253
38	38	that identifies performance goals to be implemented to improve the
39	39	performance of the campus.
40	40	(d) Subchapter B does not apply to the campus of the school
41	41	district selected for participation in the pilot program and a
42	42	campus intervention team may not be assigned under Section 39A.051
43	43	for the state fiscal biennium during which the district
44	44	participates in the program established under this section.
45	45	(e) A district participating in the pilot program is
46	46	entitled to additional state aid to implement the campus
47	47	improvement plan described by Subsection (c). For each student of
48	48	the campus in average daily attendance the district will receive
49	49	additional funding in an amount equal to what the campus would
50	50	receive under Section 12.106 if the campus was an open-enrollment
51	51	charter school. A school district may use additional state aid only
52	52	for the purpose of implementing the campus improvement plan.
53	53	(f) Not later than August 31 of the second school year of the
54	54	state fiscal biennium during which a school district participates
55	55	in the pilot program, the board of trustees of the district shall
56	56	issue a report to the commissioner regarding the implementation of
57	57	the campus improvement plan. The report must provide the most
58	58	recent performance rating of the campus and indicate whether the
59	59	campus improved under the plan. A school district's participation
60	60	in the program ends on August 31 of the second school year of the
61	61	state fiscal biennium.
62	62	(g) If the performance of a campus that is the subject of a
63	63	campus improvement plan described by Subsection (c) is assigned an
64	64	overall performance rating under Subchapter C, Chapter 39, for the
65	65	second school year of the state fiscal biennium during which the
66	66	school district participates in the pilot program that is two or
67	67	more performance ratings higher than the performance rating
68	68	assigned the campus for the school year preceding the district's
69	69	participation in the program, the district is entitled to the
70	70	additional state aid described by Subsection (e) for each school
71	71	year of the state fiscal biennium occurring after the district's
72	72	participation in the program ends under Subsection (f).
73	73	(h) The commissioner shall adopt rules as necessary to
74	74	implement this section.
75	75	SECTION 2. This Act takes effect immediately if it receives
76	76	a vote of two-thirds of all the members elected to each house, as
77	77	provided by Section 39, Article III, Texas Constitution. If this
78	78	Act does not receive the vote necessary for immediate effect, this
79	79	Act takes effect September 1, 2019.
