66 AN ACT
77 relating to a pilot program to provide additional funding to a
88 school district to improve the performance of certain campuses
99 under the accountability system.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter Z, Chapter 39A, Education Code, is
1212 amended by adding Section 39A.907 to read as follows:
1313 Sec. 39A.907. PILOT PROGRAM FOR ADDITIONAL STATE AID FOR
1414 CAMPUS IMPROVEMENT. (a) The commissioner shall establish a campus
1515 improvement pilot program in which a participating school district
1616 with a campus that is assigned an overall performance rating of
1717 needs improvement or unacceptable performance under Subchapter C,
1818 Chapter 39, will receive additional state aid to implement a campus
1919 improvement plan.
2020 (b) The commissioner shall select not more than 12 school
2121 districts in each state fiscal biennium to participate in the pilot
2222 program. A district is eligible to apply to the commissioner to
2323 participate in the program if:
2424 (1) the district has a campus that is assigned an
2525 overall performance rating under Subchapter C, Chapter 39, of needs
2626 improvement or unacceptable performance;
2727 (2) the district is located in a municipality or a
2828 county with a high proportion of open-enrollment charter schools
2929 relative to other municipalities or counties in this state, as
3030 determined by the commissioner; and
3131 (3) an open-enrollment charter school operating for
3232 the first year is located in the boundaries of the district.
3333 (c) A school district that meets the eligibility criteria
3434 established under Subsection (b) and commissioner rules adopted
3535 under this section may apply to the commissioner for selection to
3636 participate in the pilot program. To be selected, the district must
3737 submit a campus improvement plan as described by Section 11.253
3838 that identifies performance goals to be implemented to improve the
3939 performance of the campus.
4040 (d) Subchapter B does not apply to the campus of the school
4141 district selected for participation in the pilot program and a
4242 campus intervention team may not be assigned under Section 39A.051
4343 for the state fiscal biennium during which the district
4444 participates in the program established under this section.
4545 (e) A district participating in the pilot program is
4646 entitled to additional state aid to implement the campus
4747 improvement plan described by Subsection (c). For each student of
4848 the campus in average daily attendance the district will receive
4949 additional funding in an amount equal to what the campus would
5050 receive under Section 12.106 if the campus was an open-enrollment
5151 charter school. A school district may use additional state aid only
5252 for the purpose of implementing the campus improvement plan.
5353 (f) Not later than August 31 of the second school year of the
5454 state fiscal biennium during which a school district participates
5555 in the pilot program, the board of trustees of the district shall
5656 issue a report to the commissioner regarding the implementation of
5757 the campus improvement plan. The report must provide the most
5858 recent performance rating of the campus and indicate whether the
5959 campus improved under the plan. A school district's participation
6060 in the program ends on August 31 of the second school year of the
6161 state fiscal biennium.
6262 (g) If the performance of a campus that is the subject of a
6363 campus improvement plan described by Subsection (c) is assigned an
6464 overall performance rating under Subchapter C, Chapter 39, for the
6565 second school year of the state fiscal biennium during which the
6666 school district participates in the pilot program that is two or
6767 more performance ratings higher than the performance rating
6868 assigned the campus for the school year preceding the district's
6969 participation in the program, the district is entitled to the
7070 additional state aid described by Subsection (e) for each school
7171 year of the state fiscal biennium occurring after the district's
7272 participation in the program ends under Subsection (f).
7373 (h) The commissioner shall adopt rules as necessary to
7474 implement this section.
7575 SECTION 2. This Act takes effect immediately if it receives
7676 a vote of two-thirds of all the members elected to each house, as
7777 provided by Section 39, Article III, Texas Constitution. If this
7878 Act does not receive the vote necessary for immediate effect, this
7979 Act takes effect September 1, 2019.
