55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the requirement that an applicant for a reciprocal
88 license, certificate, or permit to practice barbering or
99 cosmetology pass an examination; authorizing a fee.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 1603.204(b), Occupations Code, is
1212 amended to read as follows:
1313 (b) The person must:
1414 (1) submit an application for the license,
1515 certificate, or permit to the department; [and]
1616 (2) pay fees in an amount prescribed by the
1717 commission, including any applicable license, certificate, [or]
1818 permit, or examination fee; and
1919 (3) pass the applicable examination required for
2020 issuance of the license, certificate, or permit.
2121 SECTION 2. (a) Not later than December 1, 2019, the Texas
2222 Commission of Licensing and Regulation shall adopt rules necessary
2323 to implement the changes in law made by this Act.
2424 (b) Section 1603.204(b), Occupations Code, as amended by
2525 this Act, applies only to an application for the issuance of a
2626 license, certificate, or permit submitted to the Texas Department
2727 of Licensing and Regulation on or after the effective date of this
2828 Act. An application submitted before the effective date of this Act
2929 is governed by the law in effect on the date the application was
3030 submitted, and the former law is continued in effect for that
3131 purpose.
3232 SECTION 3. This Act takes effect September 1, 2019.
