66 AN ACT
77 relating to the issuance of a permit by certain port authorities for
88 the operation and movement of oversize vehicles.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 623.212, Transportation Code, is amended
1111 to read as follows:
1212 Sec. 623.212. PERMITS BY PORT AUTHORITY. (a) The
1313 commission may authorize a port authority to issue permits for the
1414 movement of oversize or overweight vehicles carrying cargo on state
1515 highways located in counties:
1616 (1) contiguous to the Gulf of Mexico or a bay or inlet
1717 opening into the gulf and:
1818 (A) adjacent to at least two counties with a
1919 population of 550,000 or more; or
2020 (B) bordering the United Mexican States; or
2121 (2) contiguous to the Gulf of Mexico or a bay or inlet
2222 opening into the gulf with a population of not more than 200,000 and
2323 adjacent to a county described by Subdivision (1)(A).
2424 (b) A permit issued under this subchapter may authorize the
2525 movement of a combination of vehicles that exceed the maximum
2626 length allowed by other law to be transported over a state highway
2727 only if the combination:
2828 (1) uses only the routes designated under Section
2929 623.219; and
3030 (2) is carrying cargo across an international border.
3131 (c) A port authority may not issue a permit under this
3232 section unless the combination of vehicles may be operated without
3333 material damage to the highway.
3434 SECTION 2. This Act takes effect September 1, 2019.
