| 7 | 7 | | relating to the issuance of a permit by certain port authorities for |

| 8 | 8 | | the operation and movement of oversize vehicles. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 623.212, Transportation Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | Sec. 623.212. PERMITS BY PORT AUTHORITY. (a) The |
|---|
| 13 | 13 | | commission may authorize a port authority to issue permits for the |
|---|
| 14 | 14 | | movement of oversize or overweight vehicles carrying cargo on state |
|---|
| 15 | 15 | | highways located in counties: |
|---|
| 16 | 16 | | (1) contiguous to the Gulf of Mexico or a bay or inlet |
|---|
| 17 | 17 | | opening into the gulf and: |
|---|
| 18 | 18 | | (A) adjacent to at least two counties with a |
|---|
| 19 | 19 | | population of 550,000 or more; or |
|---|
| 20 | 20 | | (B) bordering the United Mexican States; or |
|---|
| 21 | 21 | | (2) contiguous to the Gulf of Mexico or a bay or inlet |
|---|
| 22 | 22 | | opening into the gulf with a population of not more than 200,000 and |
|---|
| 23 | 23 | | adjacent to a county described by Subdivision (1)(A). |

| 24 | 24 | | (b) A permit issued under this subchapter may authorize the |
|---|
| 25 | 25 | | movement of a combination of vehicles that exceed the maximum |
|---|
| 26 | 26 | | length allowed by other law to be transported over a state highway |
|---|
| 27 | 27 | | only if the combination: |
|---|
| 28 | 28 | | (1) uses only the routes designated under Section |
|---|
| 29 | 29 | | 623.219; and |
|---|
| 30 | 30 | | (2) is carrying cargo across an international border. |
|---|
| 31 | 31 | | (c) A port authority may not issue a permit under this |
|---|
| 32 | 32 | | section unless the combination of vehicles may be operated without |
|---|
| 33 | 33 | | material damage to the highway. |
|---|
| 34 | 34 | | SECTION 2. This Act takes effect September 1, 2019. |
