46 AN ACT
57 relating to the threshold contract amount at which a county is
68 required to engage in a competitive purchasing procedure for
79 certain purchases.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Sections 252.312(b) and (c), Transportation
1012 Code, are amended to read as follows:
1113 (b) If the county road engineer so recommends and the
1214 commissioners court considers it to be in the best interest of the
1315 county, a purchase in an amount of $50,000 [$25,000] or less may be
1416 made through negotiation by the commissioners court or the court's
1517 authorized representative on requisition to be approved by the
1618 commissioners court or the county auditor without advertising for
1719 competitive bids.
1820 (c) A purchase may not be divided or reduced to avoid the
1921 competitive bidding requirement on a purchase that would otherwise
2022 cost more than $50,000 [$25,000].
2123 SECTION 2. The change in law made by this Act applies only
2224 to a purchase commenced on or after September 1, 2019. A purchase
2325 for which competitive bids are advertised before September 1, 2019,
2426 is governed by the law in effect on the date the bids were
2527 advertised, and that law is continued in effect for that purpose.
2628 SECTION 3. This Act takes effect September 1, 2019.
