55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prosecution of the offense of aggravated
88 kidnapping; creating a criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 20.04, Penal Code, is amended by adding
1111 Subsections (b-1) and (b-2) to read as follows:
1212 (b-1) A person commits an offense if the person
1313 intentionally or knowingly abducts a child younger than 18 years of
1414 age.
1515 (b-2) It is an affirmative defense to prosecution under
1616 Subsection (b-1) that:
1717 (1) the abduction was not coupled with intent to use or
1818 to threaten to use deadly force;
1919 (2) the actor was a relative of the victim; and
2020 (3) the actor's sole intent was to assume lawful
2121 control of the victim.
2222 SECTION 2. The change in law made by this Act applies only
2323 to an offense committed on or after the effective date of this Act.
2424 An offense committed before the effective date of this Act is
2525 governed by the law in effect on the date the offense was committed,
2626 and the former law is continued in effect for that purpose. For
2727 purposes of this section, an offense was committed before the
2828 effective date of this Act if any element of the offense occurred
2929 before that date.
3030 SECTION 3. This Act takes effect September 1, 2019.
