66 AN ACT
77 relating to the possession and administration of epinephrine
88 auto-injectors in day-care centers; limiting liability.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 42, Human Resources Code,
1111 is amended by adding Section 42.067 to read as follows:
1212 Sec. 42.067. EPINEPHRINE AUTO-INJECTORS; IMMUNITY FROM
1313 LIABILITY. (a) In this section:
1414 (1) "Anaphylaxis" means a sudden, severe, and
1515 potentially life-threatening allergic reaction that occurs when a
1616 person is exposed to an allergen.
1717 (2) "Epinephrine auto-injector" means a disposable
1818 medical drug delivery device that contains a premeasured single
1919 dose of epinephrine intended for use to treat anaphylaxis.
2020 (3) "Physician" means a person who holds a license to
2121 practice medicine in this state.
2222 (b) A physician, or a person who has been delegated
2323 prescriptive authority under Chapter 157, Occupations Code, may
2424 prescribe epinephrine auto-injectors in the name of a day-care
2525 center.
2626 (c) A physician or other person who prescribes epinephrine
2727 auto-injectors under Subsection (b) shall provide the day-care
2828 center with a standing order for the administration of an
2929 epinephrine auto-injector to a person reasonably believed to be
3030 experiencing anaphylaxis.
3131 (d) A standing order under Subsection (c) is not required to
3232 be patient-specific. An epinephrine auto-injector may be
3333 administered under this section to a person without a previously
3434 established physician-patient relationship.
3535 (e) Notwithstanding any other law, supervision or
3636 delegation by a physician is considered adequate if the physician:
3737 (1) periodically reviews the order; and
3838 (2) is available through direct telecommunication as
3939 needed for consultation, assistance, and direction.
4040 (f) An order issued under this section must contain:
4141 (1) the name and signature of the prescribing
4242 physician or other person;
4343 (2) the name of the day-care center to which the order
4444 is issued;
4545 (3) the quantity of epinephrine auto-injectors to be
4646 obtained and maintained under the order; and
4747 (4) the date the order was issued.
4848 (g) A pharmacist may dispense an epinephrine auto-injector
4949 to a day-care center without requiring the name of or any other
5050 identifying information relating to the user.
5151 (h) Each day-care center is responsible for training
5252 personnel in the administration of an epinephrine auto-injector.
5353 The training must:
5454 (1) include information on:
5555 (A) the signs and symptoms of anaphylaxis;
5656 (B) the administration of an epinephrine
5757 auto-injector;
5858 (C) the recommended dosages for adults and
5959 children by age and weight, if applicable, and the dosages
6060 available at the center;
6161 (D) the implementation of emergency procedures,
6262 if necessary, after administering an epinephrine auto-injector;
6363 and
6464 (E) the proper disposal of used or expired
6565 epinephrine auto-injectors; and
6666 (2) be completed annually in a formal training session
6767 or through online education.
6868 (i) Each day-care center shall maintain records on the
6969 training required under this section.
7070 (j) A person who in good faith takes, or fails to take,
7171 action relating to the prescription of an epinephrine auto-injector
7272 to a day-care center or the administration of an epinephrine
7373 auto-injector in a day-care center is immune from civil or criminal
7474 liability or disciplinary action resulting from that action or
7575 failure to act, including:
7676 (1) issuing an order for epinephrine auto-injectors;
7777 (2) supervising or delegating the administration of an
7878 epinephrine auto-injector;
7979 (3) possessing, maintaining, storing, or disposing of
8080 an epinephrine auto-injector;
8181 (4) prescribing an epinephrine auto-injector;
8282 (5) dispensing an epinephrine auto-injector;
8383 (6) administering, or assisting in administering, an
8484 epinephrine auto-injector;
8585 (7) providing, or assisting in providing, training,
8686 consultation, or advice in the development, adoption, or
8787 implementation of policies, guidelines, rules, or plans; or
8888 (8) undertaking any other act permitted or required
8989 under this section.
9090 (k) The immunities and protections provided by this section
9191 are in addition to other immunities or limitations of liability
9292 provided by law.
9393 (l) Notwithstanding any other law, this section does not
9494 create a civil, criminal, or administrative cause of action or
9595 liability or create a standard of care, obligation, or duty that
9696 provides a basis for a cause of action for an act or omission under
9797 this section.
9898 (m) An act or omission described by this section does not
9999 create a cause of action.
100100 SECTION 2. This Act takes effect immediately if it receives
101101 a vote of two-thirds of all the members elected to each house, as
102102 provided by Section 39, Article III, Texas Constitution. If this
103103 Act does not receive the vote necessary for immediate effect, this
104104 Act takes effect September 1, 2019.
