66 AN ACT
77 relating to certain duties of a sheriff regarding a county jail
88 prisoner's health benefits coverage information.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 511, Government Code, is amended by
1111 adding Section 511.0098 to read as follows:
1212 Sec. 511.0098. PRISONER HEALTH BENEFITS COVERAGE
1313 INFORMATION; PAYMENT FOR HEALTH CARE SERVICES. (a) The commission
1414 shall adopt procedures by which a sheriff may collect the following
1515 from a prisoner who is covered by health insurance or other health
1616 benefits coverage:
1717 (1) the name of the policyholder or group contract
1818 holder;
1919 (2) the number of the policy or evidence of coverage;
2020 (3) a copy of the health coverage membership card, if
2121 available; and
2222 (4) any other information necessary for the prisoner
2323 to obtain benefits under the coverage.
2424 (b) The commission by rule shall require a sheriff to
2525 collect the information and documentation described by Subsection
2626 (a) for any prisoner in the sheriff's jurisdiction who is confined
2727 in a county jail capable of confining 800 or more prisoners.
2828 (c) A sheriff who arranges for health care services to be
2929 provided to a prisoner for whom the sheriff has obtained health
3030 insurance or other health benefits coverage information under this
3131 section may:
3232 (1) provide the information to a health care provider
3333 or health care facility providing the services to the prisoner; and
3434 (2) arrange for the issuer of the health insurance
3535 policy or other health benefits coverage to pay for the services.
3636 SECTION 2. This Act takes effect September 1, 2019.
