7 | 7 | | relating to training requirements and prohibited discrimination |
---|
8 | 8 | | for child-care facilities and registered family homes. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 42.042(e), Human Resources Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (e) The executive commissioner shall promulgate minimum |
---|
13 | 13 | | standards that apply to licensed child-care facilities and to |
---|
14 | 14 | | registered family homes covered by this chapter and that will: |
---|
15 | 15 | | (1) promote the health, safety, and welfare of |
---|
16 | 16 | | children attending a facility or registered family home; |
---|
17 | 17 | | (2) promote safe, comfortable, and healthy physical |
---|
18 | 18 | | facilities and registered family homes for children; |
---|
19 | 19 | | (3) ensure adequate supervision of children by |
---|
20 | 20 | | capable, qualified, and healthy personnel; |
---|
21 | 21 | | (4) ensure adequate and healthy food service where |
---|
22 | 22 | | food service is offered; |
---|
23 | 23 | | (5) prohibit [racial] discrimination based on race or |
---|
24 | 24 | | disability by child-care facilities and registered family homes; |
---|
25 | 25 | | (6) require procedures for parental and guardian |
---|
26 | 26 | | consultation in the formulation of children's educational and |
---|
27 | 27 | | therapeutic programs; |
---|
28 | 28 | | (7) prevent the breakdown of foster care and adoptive |
---|
29 | 29 | | placement; and |
---|
30 | 30 | | (8) ensure that a child-care facility or registered |
---|
31 | 31 | | family home: |
---|
32 | 32 | | (A) follows the directions of a child's physician |
---|
33 | 33 | | or other health care provider in providing specialized medical |
---|
34 | 34 | | assistance required by the child; and |
---|
35 | 35 | | (B) maintains for a reasonable time a copy of any |
---|
36 | 36 | | directions from the physician or provider that the parent provides |
---|
37 | 37 | | to the facility or home. |
---|
38 | 38 | | SECTION 2. Section 42.0421, Human Resources Code, is |
---|
39 | 39 | | amended by adding Subsections (a-1) and (a-2) to read as follows: |
---|
40 | 40 | | (a-1) The initial training described by Subsection (a)(1) |
---|
41 | 41 | | must include training on: |
---|
42 | 42 | | (1) trauma-informed care; and |
---|
43 | 43 | | (2) behavioral health that includes: |
---|
44 | 44 | | (A) methods for: |
---|
45 | 45 | | (i) understanding and managing behaviors; |
---|
46 | 46 | | (ii) requesting a consultation; and |
---|
47 | 47 | | (iii) providing support to all children who |
---|
48 | 48 | | are provided care; and |
---|
49 | 49 | | (B) a description of the impact autism and other |
---|
50 | 50 | | intellectual and developmental disabilities have on behavior and |
---|
51 | 51 | | communication. |
---|
52 | 52 | | (a-2) The annual training described by Subsection (a)(2) |
---|
53 | 53 | | must include training on providing care to children with special |
---|
54 | 54 | | needs that includes methods for: |
---|
55 | 55 | | (1) identifying possible developmental delays; |
---|
56 | 56 | | (2) locating community resources for the children; |
---|
57 | 57 | | (3) providing effective communication to the |
---|
58 | 58 | | children's parents; and |
---|
59 | 59 | | (4) accommodating the special needs of children in the |
---|
60 | 60 | | classroom. |
---|
61 | 61 | | SECTION 3. As soon as practicable after the effective date |
---|
62 | 62 | | of this Act, the executive commissioner of the Health and Human |
---|
63 | 63 | | Services Commission shall adopt the rules necessary to implement |
---|
64 | 64 | | the changes in law made by this Act. |
---|
65 | 65 | | SECTION 4. This Act takes effect September 1, 2019. |
