55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to training requirements and prohibited discrimination
88 for child-care facilities and registered family homes.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 42.042(e), Human Resources Code, is
1111 amended to read as follows:
1212 (e) The executive commissioner shall promulgate minimum
1313 standards that apply to licensed child-care facilities and to
1414 registered family homes covered by this chapter and that will:
1515 (1) promote the health, safety, and welfare of
1616 children attending a facility or registered family home;
1717 (2) promote safe, comfortable, and healthy physical
1818 facilities and registered family homes for children;
1919 (3) ensure adequate supervision of children by
2020 capable, qualified, and healthy personnel;
2121 (4) ensure adequate and healthy food service where
2222 food service is offered;
2323 (5) prohibit [racial] discrimination based on race or
2424 disability by child-care facilities and registered family homes;
2525 (6) require procedures for parental and guardian
2626 consultation in the formulation of children's educational and
2727 therapeutic programs;
2828 (7) prevent the breakdown of foster care and adoptive
2929 placement; and
3030 (8) ensure that a child-care facility or registered
3131 family home:
3232 (A) follows the directions of a child's physician
3333 or other health care provider in providing specialized medical
3434 assistance required by the child; and
3535 (B) maintains for a reasonable time a copy of any
3636 directions from the physician or provider that the parent provides
3737 to the facility or home.
3838 SECTION 2. Section 42.0421, Human Resources Code, is
3939 amended by adding Subsections (a-1) and (a-2) to read as follows:
4040 (a-1) The initial training described by Subsection (a)(1)
4141 must include training on:
4242 (1) trauma-informed care; and
4343 (2) behavioral health that includes:
4444 (A) methods for:
4545 (i) understanding and managing behaviors;
4646 (ii) requesting a consultation; and
4747 (iii) providing support to all children who
4848 are provided care; and
4949 (B) a description of the impact autism and other
5050 intellectual and developmental disabilities have on behavior and
5151 communication.
5252 (a-2) The annual training described by Subsection (a)(2)
5353 must include training on providing care to children with special
5454 needs that includes methods for:
5555 (1) identifying possible developmental delays;
5656 (2) locating community resources for the children;
5757 (3) providing effective communication to the
5858 children's parents; and
5959 (4) accommodating the special needs of children in the
6060 classroom.
6161 SECTION 3. As soon as practicable after the effective date
6262 of this Act, the executive commissioner of the Health and Human
6363 Services Commission shall adopt the rules necessary to implement
6464 the changes in law made by this Act.
6565 SECTION 4. This Act takes effect September 1, 2019.
