7 | 7 | | relating to a study by the Texas Commission on Law Enforcement of |

8 | 8 | | the reporting and use of information concerning the termination of |
---|
9 | 9 | | a license holder's employment. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. In this Act: |
---|
12 | 12 | | (1) "Commission" means the Texas Commission on Law |
---|
13 | 13 | | Enforcement. |
---|
14 | 14 | | (2) "License holder" means a person licensed under |
---|
15 | 15 | | Chapter 1701, Occupations Code. |
---|
16 | 16 | | SECTION 2. The commission shall study: |
---|
17 | 17 | | (1) compliance by law enforcement agencies with the |
---|
18 | 18 | | requirement that a law enforcement agency: |
---|
19 | 19 | | (A) submit employment termination reports to the |
---|
20 | 20 | | commission under Section 1701.452, Occupations Code, for a license |
---|
21 | 21 | | holder who resigns or retires from employment with the law |
---|
22 | 22 | | enforcement agency, whose appointment with the law enforcement |
---|
23 | 23 | | agency is terminated, or who separates from the law enforcement |
---|
24 | 24 | | agency for any other reason; and |
---|
25 | 25 | | (B) obtain under Section 1701.451, Occupations |
---|
26 | 26 | | Code, employment termination reports regarding an applicant for |
---|
27 | 27 | | employment with the agency; and |
---|
28 | 28 | | (2) the extent to which law enforcement agencies use |
---|
29 | 29 | | the information in an employment termination report to make |
---|
30 | 30 | | employment decisions. |
---|
31 | 31 | | SECTION 3. Not later than December 1, 2020, the commission |
---|
32 | 32 | | shall report the results of the study and make recommendations to |
---|
33 | 33 | | the legislature regarding improving the reporting and |
---|
34 | 34 | | consideration of information concerning license holder |
---|
35 | 35 | | terminations or separations. |
---|
36 | 36 | | SECTION 4. This Act expires January 1, 2021. |
---|
37 | 37 | | SECTION 5. This Act takes effect September 1, 2019. |
