55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study by the Texas Commission on Law Enforcement of
88 the reporting and use of information concerning the termination of
99 a license holder's employment.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. In this Act:
1212 (1) "Commission" means the Texas Commission on Law
1313 Enforcement.
1414 (2) "License holder" means a person licensed under
1515 Chapter 1701, Occupations Code.
1616 SECTION 2. The commission shall study:
1717 (1) compliance by law enforcement agencies with the
1818 requirement that a law enforcement agency:
1919 (A) submit employment termination reports to the
2020 commission under Section 1701.452, Occupations Code, for a license
2121 holder who resigns or retires from employment with the law
2222 enforcement agency, whose appointment with the law enforcement
2323 agency is terminated, or who separates from the law enforcement
2424 agency for any other reason; and
2525 (B) obtain under Section 1701.451, Occupations
2626 Code, employment termination reports regarding an applicant for
2727 employment with the agency; and
2828 (2) the extent to which law enforcement agencies use
2929 the information in an employment termination report to make
3030 employment decisions.
3131 SECTION 3. Not later than December 1, 2020, the commission
3232 shall report the results of the study and make recommendations to
3333 the legislature regarding improving the reporting and
3434 consideration of information concerning license holder
3535 terminations or separations.
3636 SECTION 4. This Act expires January 1, 2021.
3737 SECTION 5. This Act takes effect September 1, 2019.
