| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Section 38.14(b), Penal Code, is amended to read |
|---|
| 10 | 12 | | as follows: |
|---|
| 11 | 13 | | (b) A person commits an offense if the person intentionally |
|---|
| 12 | 14 | | or knowingly and with force takes or attempts to take from a peace |
|---|
| 13 | 15 | | officer, federal special investigator, employee or official of a |
|---|
| 14 | 16 | | correctional facility, parole officer, community supervision and |
|---|
| 15 | 17 | | corrections department officer, or commissioned security officer |
|---|
| 16 | 18 | | the officer's, investigator's, employee's, or official's firearm, |
|---|
| 17 | 19 | | nightstick, stun gun, or personal protection chemical dispensing |
|---|
| 18 | 20 | | device [with the intention of harming the officer, investigator, |
|---|
| 19 | 21 | | employee, or official or a third person]. |
|---|
| 20 | 22 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 21 | 23 | | to an offense committed on or after the effective date of this Act. |
|---|
| 22 | 24 | | An offense committed before the effective date of this Act is |
|---|
| 23 | 25 | | governed by the law in effect when the offense was committed, and |
|---|
| 24 | 26 | | the former law is continued in effect for that purpose. For |
|---|
| 25 | 27 | | purposes of this section, an offense was committed before the |
|---|
| 26 | 28 | | effective date of this Act if any element of the offense occurred |
|---|
| 27 | 29 | | before that date. |

| 28 | 30 | | SECTION 3. This Act takes effect September 1, 2019. |
