46 AN ACT
57 relating to the prosecution of the offense of taking or attempting
68 to take a weapon from certain officers, investigators, employees,
79 or officials.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 38.14(b), Penal Code, is amended to read
1012 as follows:
1113 (b) A person commits an offense if the person intentionally
1214 or knowingly and with force takes or attempts to take from a peace
1315 officer, federal special investigator, employee or official of a
1416 correctional facility, parole officer, community supervision and
1517 corrections department officer, or commissioned security officer
1618 the officer's, investigator's, employee's, or official's firearm,
1719 nightstick, stun gun, or personal protection chemical dispensing
1820 device [with the intention of harming the officer, investigator,
1921 employee, or official or a third person].
2022 SECTION 2. The change in law made by this Act applies only
2123 to an offense committed on or after the effective date of this Act.
2224 An offense committed before the effective date of this Act is
2325 governed by the law in effect when the offense was committed, and
2426 the former law is continued in effect for that purpose. For
2527 purposes of this section, an offense was committed before the
2628 effective date of this Act if any element of the offense occurred
2729 before that date.
2830 SECTION 3. This Act takes effect September 1, 2019.
