65 AN ACT
76 relating to the application of certain occupation-related
87 postsecondary educational financial aid and student loan repayment
98 programs.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. Section 61.605(a), Education Code, is amended to
1211 read as follows:
1312 (a) The board may provide repayment assistance under this
1413 subchapter for the repayment of any student loan, including a loan
1514 for undergraduate education, received by an eligible person through
1615 any lender for education at:
1716 (1) an institution of higher education;
1817 (2) [,] a private or independent institution of higher
1918 education;
2019 (3) [, or] a public or private out-of-state
2120 institution of higher education accredited by a recognized
2221 accrediting agency; or
2322 (4) a nonprofit, tax-exempt, regionally accredited
2423 college or university operating in accordance with a memorandum of
2524 understanding with this state under an executive order issued by
2625 the governor[, including loans for undergraduate education,
2726 received by an eligible person through any lender].
2827 SECTION 2. Section 61.608(b), Education Code, is amended to
2928 read as follows:
3029 (b) The board shall distribute to each institution of higher
3130 education or private or independent institution of higher
3231 education, each college or university described by Section
3332 61.605(a)(4), and [to] any appropriate state agency and
3433 professional association copies of the rules adopted under this
3534 section and other pertinent information relating to this
3635 subchapter.
3736 SECTION 3. Section 61.9621, Education Code, is amended to
3837 read as follows:
3938 Sec. 61.9621. DEFINITION. In this subchapter,
4039 "professional nursing program" means an educational program
4140 preparing students for initial licensure as registered nurses
4241 offered by:
4342 (1) a public or private institution of higher
4443 education; or
4544 (2) a nonprofit, tax-exempt, regionally accredited
4645 college or university operating in accordance with a memorandum of
4746 understanding with this state under an executive order issued by
4847 the governor [for preparing students for initial licensure as
4948 registered nurses].
5049 SECTION 4. Section 61.96232(a), Education Code, is amended
5150 to read as follows:
5251 (a) The board by rule shall establish a process under which
5352 a public or private institution of higher education or an
5453 institution described by Section 61.9621(2) that offers a
5554 professional nursing program may apply for a grant under this
5655 subchapter and the commissioner of higher education, contingent on
5756 appropriations of money for the grants, selects one or more
5857 applicants to receive a grant based on criteria established by
5958 board rule. The criteria must include the institution's agreement
6059 that the institution's professional nursing program will enroll
6160 additional students or graduate additional students prepared for
6261 initial licensure as registered nurses.
6362 SECTION 5. Section 61.9751(2), Education Code, is amended
6463 to read as follows:
6564 (2) "Nursing education program" means:
6665 (A) an undergraduate professional nursing
6766 program or a graduate professional nursing program as those terms
6867 are defined by Section 54.355; and
6968 (B) a comparable nursing program offered by a
7069 nonprofit, tax-exempt, regionally accredited college or university
7170 operating in accordance with a memorandum of understanding with
7271 this state under an executive order issued by the governor.
7372 SECTION 6. Section 61.9821, Education Code, is amended to
7473 read as follows:
7574 Sec. 61.9821. REPAYMENT AUTHORIZED. The board shall
7675 establish and administer a program to provide, in accordance with
7776 this subchapter and board rules, assistance in the repayment of
7877 student loans for nurses who:
7978 (1) are serving on the faculties of nursing degree
8079 programs at institutions to which this subchapter applies [of
8180 higher education or private or independent institutions of higher
8281 education] in positions that require an advanced degree in
8382 professional nursing; and
8483 (2) apply and qualify for the assistance.
8584 SECTION 7. Subchapter JJ, Chapter 61, Education Code, is
8685 amended by adding Section 61.98211 to read as follows:
8786 Sec. 61.98211. APPLICABILITY OF SUBCHAPTER. This
8887 subchapter applies to:
8988 (1) an institution of higher education;
9089 (2) a private or independent institution of higher
9190 education; and
9291 (3) a nonprofit, tax-exempt, regionally accredited
9392 college or university operating in accordance with a memorandum of
9493 understanding with this state under an executive order issued by
9594 the governor.
9695 SECTION 8. Section 61.9822, Education Code, is amended to
9796 read as follows:
9897 Sec. 61.9822. ELIGIBILITY. To be eligible to receive loan
9998 repayment assistance under this subchapter, a nurse must:
10099 (1) apply to the board;
101100 (2) at the time of application for repayment
102101 assistance have been employed full-time for at least one year as,
103102 and be currently employed full-time as, a faculty member of a
104103 nursing degree program at an institution to which this subchapter
105104 applies [of higher education or a private or independent
106105 institution of higher education]; and
107106 (3) comply with any additional requirements adopted by
108107 board rule.
109108 SECTION 9. Section 61.9823(a), Education Code, is amended
110109 to read as follows:
111110 (a) On qualifying for loan repayment assistance under this
112111 subchapter, a nurse may receive repayment assistance for each year
113112 of full-time employment as a faculty member of a nursing degree
114113 program at an institution to which this subchapter applies [of
115114 higher education or private or independent institution of higher
116115 education], not to exceed five years.
117116 SECTION 10. Section 61.9824(a), Education Code, is amended
118117 to read as follows:
119118 (a) The board may provide repayment assistance for the
120119 repayment of any student loan received by an eligible person
121120 through any lender that is for education, including undergraduate
122121 education, at:
123122 (1) a public or private institution of higher
124123 education; or
125124 (2) a nonprofit, tax-exempt, regionally accredited
126125 college or university operating in accordance with a memorandum of
127126 understanding with this state under an executive order issued by
128127 the governor [any public or private institution of higher
129128 education, including a loan for undergraduate education, received
130129 by an eligible person through any lender].
131130 SECTION 11. Section 61.9828(b), Education Code, is amended
132131 to read as follows:
133132 (b) The board shall distribute a copy of the rules adopted
134133 under this section and pertinent information regarding this
135134 subchapter to:
136135 (1) each institution to which this subchapter applies
137136 [of higher education and private or independent institution of
138137 higher education];
139138 (2) any appropriate state agency; and
140139 (3) any appropriate professional association.
141140 SECTION 12. Section 61.9835(a), Education Code, is amended
142141 to read as follows:
143142 (a) The board may provide repayment assistance under this
144143 subchapter for the repayment of any student loan received by an
145144 eligible person through an eligible lender that[:
146145 [(1)] is for education at:
147146 (1) a public or private institution of higher
148147 education; or [and]
149148 (2) a nonprofit, tax-exempt, regionally accredited
150149 college or university operating in accordance with a memorandum of
151150 understanding with this state under an executive order issued by
152151 the governor [is received by an eligible person through an eligible
153152 lender].
154153 SECTION 13. As soon as practicable after the effective date
155154 of this Act, the Texas Higher Education Coordinating Board shall
156155 adopt any rules necessary to administer the changes in law made by
157156 this Act.
158157 SECTION 14. The Texas Higher Education Coordinating Board
159158 may not award grants under the professional nursing shortage
160159 reduction program as provided by the changes in law made by this Act
161160 to Sections 61.9621 and 61.96232, Education Code, before June 1,
162161 2021.
163162 SECTION 15. This Act takes effect immediately if it
164163 receives a vote of two-thirds of all the members elected to each
165164 house, as provided by Section 39, Article III, Texas Constitution.
166165 If this Act does not receive the vote necessary for immediate
167166 effect, this Act takes effect September 1, 2019.
