7 | 7 | | relating to the Texas State Library and Archives Commission. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 441.006(a), Government Code, is amended |
---|
10 | 10 | | to read as follows: |
---|
11 | 11 | | (a) The commission shall: |
---|
12 | 12 | | (1) govern the Texas State Library; |
---|
13 | 13 | | (2) adopt policies and rules to aid and encourage the |
---|
14 | 14 | | development of and cooperation among all types of libraries, |
---|
15 | 15 | | including public, academic, special, and other types of libraries; |
---|
16 | 16 | | (3) aid those studying problems to be dealt with by |
---|
17 | 17 | | legislation; |
---|
18 | 18 | | (4) prepare and make available to the public and |
---|
19 | 19 | | appropriate state agencies information of public interest |
---|
20 | 20 | | describing the functions of the commission; |
---|
21 | 21 | | (5) deposit money paid to the commission under this |
---|
22 | 22 | | chapter subject to Subchapter F, Chapter 404; |
---|
23 | 23 | | (6) give to any person contemplating the establishment |
---|
24 | 24 | | of a public library advice regarding matters such as maintaining a |
---|
25 | 25 | | public library, selecting books, cataloging, and managing a |
---|
26 | 26 | | library; |
---|
27 | 27 | | (7) conduct library institutes and encourage library |
---|
28 | 28 | | associations; |
---|
29 | 29 | | (8) take custody of, preserve, and make available for |
---|
30 | 30 | | public use state records and other historical resources that |
---|
31 | 31 | | document the history and culture of Texas as a province, colony, |
---|
32 | 32 | | republic, or state; |
---|
33 | 33 | | (9) prepare and make available to the public a |
---|
34 | 34 | | complete list of every state symbol and place designation, |
---|
35 | 35 | | including state symbols and place designations made in accordance |
---|
36 | 36 | | with Chapter 391; |
---|
37 | 37 | | (10) aid and encourage, by adoption of policies and |
---|
38 | 38 | | programs, the development of effective records management and |
---|
39 | 39 | | preservation programs in state agencies and the local governments |
---|
40 | 40 | | of the state; [and] |
---|
41 | 41 | | (11) provide library services to persons with |
---|
42 | 42 | | disabilities in cooperation with the federal government; and |
---|
43 | 43 | | (12) adopt rules allowing for the storage of original |
---|
44 | 44 | | documents in digital format in the state archives. |
---|
45 | 45 | | SECTION 2. Subchapter L, Chapter 441, Government Code, is |
---|
46 | 46 | | amended by adding Sections 441.1815 and 441.206 to read as follows: |
---|
47 | 47 | | Sec. 441.1815. STATE ARCHIVES STRATEGIC PLAN. The |
---|
48 | 48 | | commission, with input from interested persons, shall develop and |
---|
49 | 49 | | implement a comprehensive strategic plan regarding the state |
---|
50 | 50 | | archives. The commission shall update the strategic plan at least |
---|
51 | 51 | | once every five years. The strategic plan must include: |
---|
52 | 52 | | (1) an assessment of any current archives backlog; |
---|
53 | 53 | | (2) a prioritized list of projects and goals related |
---|
54 | 54 | | to the state archives; |
---|
55 | 55 | | (3) an evaluation of the resources needed to achieve |
---|
56 | 56 | | the commission's goals related to the state archives, including the |
---|
57 | 57 | | impact that different amounts of those resources are expected to |
---|
58 | 58 | | have on the commission's ability to achieve those goals; |
---|
59 | 59 | | (4) performance measures, targets, and time frames for |
---|
60 | 60 | | achieving the commission's goals related to the state archives; |
---|
61 | 61 | | (5) a mechanism for regular reporting to the |
---|
62 | 62 | | commission on progress toward achieving the commission's goals |
---|
63 | 63 | | related to the state archives; and |
---|
64 | 64 | | (6) opportunities and standards for entering into |
---|
65 | 65 | | collaborative agreements with interested persons regarding the |
---|
66 | 66 | | state archives. |
---|
67 | 67 | | Sec. 441.206. RECORDS OF MEMBER OF LEGISLATURE. (a) A |
---|
68 | 68 | | member of the legislature may apply to the commission to place |
---|
69 | 69 | | records of the member's legislative office created or received |
---|
70 | 70 | | during the member's term of office in a depository other than the |
---|
71 | 71 | | Texas State Library and Archives. |
---|
72 | 72 | | (b) The commission shall: |
---|
73 | 73 | | (1) create a list of preapproved depositories in which |
---|
74 | 74 | | members of the legislature may place records of their legislative |
---|
75 | 75 | | offices, including regional historical resource depositories |
---|
76 | 76 | | described by Section 441.153; and |
---|
77 | 77 | | (2) by rule adopt policies and procedures to approve |
---|
78 | 78 | | additional depositories. |
---|
79 | 79 | | (c) Ownership of records described by Subsection (a) placed |
---|
80 | 80 | | in a depository other than the Texas State Library and Archives |
---|
81 | 81 | | remains with the commission. The records may not be intermingled |
---|
82 | 82 | | with other holdings of the institution that serves as a depository. |
---|
83 | 83 | | SECTION 3. (a) Not later than September 1, 2020, the Texas |
---|
84 | 84 | | State Library and Archives Commission shall: |
---|
85 | 85 | | (1) adopt rules under Section 441.006(a), Government |
---|
86 | 86 | | Code, as amended by this Act; |
---|
87 | 87 | | (2) develop a strategic plan for the state archives |
---|
88 | 88 | | program as required by Section 441.1815, Government Code, as added |
---|
89 | 89 | | by this Act; and |
---|
90 | 90 | | (3) create a list of preapproved depositories and |
---|
91 | 91 | | adopt rules for approving additional depositories as required by |
---|
92 | 92 | | Section 441.206, Government Code, as added by this Act. |
---|
93 | 93 | | (b) Rules adopted under Section 441.206, Government Code, |
---|
94 | 94 | | as added by this Act, apply only to a member of the legislature |
---|
95 | 95 | | leaving office after September 1, 2020. |
---|
96 | 96 | | SECTION 4. This Act takes effect September 1, 2019. |
