66 AN ACT
77 relating to the Texas State Library and Archives Commission.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 441.006(a), Government Code, is amended
1010 to read as follows:
1111 (a) The commission shall:
1212 (1) govern the Texas State Library;
1313 (2) adopt policies and rules to aid and encourage the
1414 development of and cooperation among all types of libraries,
1515 including public, academic, special, and other types of libraries;
1616 (3) aid those studying problems to be dealt with by
1717 legislation;
1818 (4) prepare and make available to the public and
1919 appropriate state agencies information of public interest
2020 describing the functions of the commission;
2121 (5) deposit money paid to the commission under this
2222 chapter subject to Subchapter F, Chapter 404;
2323 (6) give to any person contemplating the establishment
2424 of a public library advice regarding matters such as maintaining a
2525 public library, selecting books, cataloging, and managing a
2626 library;
2727 (7) conduct library institutes and encourage library
2828 associations;
2929 (8) take custody of, preserve, and make available for
3030 public use state records and other historical resources that
3131 document the history and culture of Texas as a province, colony,
3232 republic, or state;
3333 (9) prepare and make available to the public a
3434 complete list of every state symbol and place designation,
3535 including state symbols and place designations made in accordance
3636 with Chapter 391;
3737 (10) aid and encourage, by adoption of policies and
3838 programs, the development of effective records management and
3939 preservation programs in state agencies and the local governments
4040 of the state; [and]
4141 (11) provide library services to persons with
4242 disabilities in cooperation with the federal government; and
4343 (12) adopt rules allowing for the storage of original
4444 documents in digital format in the state archives.
4545 SECTION 2. Subchapter L, Chapter 441, Government Code, is
4646 amended by adding Sections 441.1815 and 441.206 to read as follows:
4747 Sec. 441.1815. STATE ARCHIVES STRATEGIC PLAN. The
4848 commission, with input from interested persons, shall develop and
4949 implement a comprehensive strategic plan regarding the state
5050 archives. The commission shall update the strategic plan at least
5151 once every five years. The strategic plan must include:
5252 (1) an assessment of any current archives backlog;
5353 (2) a prioritized list of projects and goals related
5454 to the state archives;
5555 (3) an evaluation of the resources needed to achieve
5656 the commission's goals related to the state archives, including the
5757 impact that different amounts of those resources are expected to
5858 have on the commission's ability to achieve those goals;
5959 (4) performance measures, targets, and time frames for
6060 achieving the commission's goals related to the state archives;
6161 (5) a mechanism for regular reporting to the
6262 commission on progress toward achieving the commission's goals
6363 related to the state archives; and
6464 (6) opportunities and standards for entering into
6565 collaborative agreements with interested persons regarding the
6666 state archives.
6767 Sec. 441.206. RECORDS OF MEMBER OF LEGISLATURE. (a) A
6868 member of the legislature may apply to the commission to place
6969 records of the member's legislative office created or received
7070 during the member's term of office in a depository other than the
7171 Texas State Library and Archives.
7272 (b) The commission shall:
7373 (1) create a list of preapproved depositories in which
7474 members of the legislature may place records of their legislative
7575 offices, including regional historical resource depositories
7676 described by Section 441.153; and
7777 (2) by rule adopt policies and procedures to approve
7878 additional depositories.
7979 (c) Ownership of records described by Subsection (a) placed
8080 in a depository other than the Texas State Library and Archives
8181 remains with the commission. The records may not be intermingled
8282 with other holdings of the institution that serves as a depository.
8383 SECTION 3. (a) Not later than September 1, 2020, the Texas
8484 State Library and Archives Commission shall:
8585 (1) adopt rules under Section 441.006(a), Government
8686 Code, as amended by this Act;
8787 (2) develop a strategic plan for the state archives
8888 program as required by Section 441.1815, Government Code, as added
8989 by this Act; and
9090 (3) create a list of preapproved depositories and
9191 adopt rules for approving additional depositories as required by
9292 Section 441.206, Government Code, as added by this Act.
9393 (b) Rules adopted under Section 441.206, Government Code,
9494 as added by this Act, apply only to a member of the legislature
9595 leaving office after September 1, 2020.
9696 SECTION 4. This Act takes effect September 1, 2019.
