46 AN ACT
57 relating to value-based arrangements in the Medicaid vendor drug
68 program.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Subchapter B, Chapter 531, Government Code, is
911 amended by adding Section 531.0701 to read as follows:
1012 Sec. 531.0701. VALUE-BASED ARRANGEMENTS. (a) In this
1113 section, "manufacturer" has the meaning assigned by Section
1214 531.070.
1315 (b) Subject to Section 531.071, the commission may enter
1416 into a value-based arrangement for the Medicaid vendor drug program
1517 by written agreement with a manufacturer based on outcome data or
1618 other metrics to which this state and the manufacturer agree in
1719 writing. The value-based arrangement may include a rebate, a
1820 discount, a price reduction, a contribution, risk sharing, a
1921 reimbursement, payment deferral or installment payments, a
2022 guarantee, patient care, shared savings payments, withholds, a
2123 bonus, or any other thing of value.
2224 SECTION 2. If before implementing any provision of this Act
2325 a state agency determines that a waiver or authorization from a
2426 federal agency is necessary for implementation of that provision,
2527 the agency affected by the provision shall request the waiver or
2628 authorization and may delay implementing that provision until the
2729 waiver or authorization is granted.
2830 SECTION 3. The Health and Human Services Commission is
2931 required to implement a provision of this Act only if the
3032 legislature appropriates money specifically for that purpose. If
3133 the legislature does not appropriate money specifically for that
3234 purpose, the commission may, but is not required to, implement a
3335 provision of this Act using other appropriations available for that
3436 purpose.
3537 SECTION 4. This Act takes effect September 1, 2019.
