4	6		AN ACT
5	7		relating to value-based arrangements in the Medicaid vendor drug
6	8		program.
7	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	10		SECTION 1. Subchapter B, Chapter 531, Government Code, is
9	11		amended by adding Section 531.0701 to read as follows:
10	12		Sec. 531.0701. VALUE-BASED ARRANGEMENTS. (a) In this
11	13		section, "manufacturer" has the meaning assigned by Section
12	14		531.070.
13	15		(b) Subject to Section 531.071, the commission may enter
14	16		into a value-based arrangement for the Medicaid vendor drug program
15	17		by written agreement with a manufacturer based on outcome data or
16	18		other metrics to which this state and the manufacturer agree in
17	19		writing. The value-based arrangement may include a rebate, a
18	20		discount, a price reduction, a contribution, risk sharing, a
19	21		reimbursement, payment deferral or installment payments, a
20	22		guarantee, patient care, shared savings payments, withholds, a
21	23		bonus, or any other thing of value.
22	24		SECTION 2. If before implementing any provision of this Act
23	25		a state agency determines that a waiver or authorization from a
24	26		federal agency is necessary for implementation of that provision,
25	27		the agency affected by the provision shall request the waiver or
26	28		authorization and may delay implementing that provision until the
27	29		waiver or authorization is granted.
28	30		SECTION 3. The Health and Human Services Commission is
29	31		required to implement a provision of this Act only if the
30	32		legislature appropriates money specifically for that purpose. If
31	33		the legislature does not appropriate money specifically for that
32	34		purpose, the commission may, but is not required to, implement a
33	35		provision of this Act using other appropriations available for that
34	36		purpose.
35	37		SECTION 4. This Act takes effect September 1, 2019.
