55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to peer specialists and the provision of peer services to
88 individuals with an intellectual or developmental disability.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 531.0999(a) and (b), Government Code,
1111 as added by Chapter 1015 (H.B. 1486), Acts of the 85th Legislature,
1212 Regular Session, 2017, are amended to read as follows:
1313 (a) With input from mental health, intellectual or
1414 developmental disability, and substance use peer specialists and
1515 the work group described by Subsection (b), the commission shall
1616 develop and the executive commissioner shall adopt:
1717 (1) rules that establish training requirements for
1818 peer specialists so that they are able to provide services to
1919 persons with a mental illness or intellectual or developmental
2020 disability or services to persons with substance use conditions;
2121 (2) rules that establish certification and
2222 supervision requirements for peer specialists;
2323 (3) rules that define the scope of services that peer
2424 specialists may provide;
2525 (4) rules that distinguish peer services from other
2626 services that a person must hold a license to provide; and
2727 (5) any other rules necessary to protect the health
2828 and safety of persons receiving peer services.
2929 (b) The commission shall establish a stakeholder work group
3030 to provide input for the adoption of rules under Subsection
3131 (a). The work group is composed of the following stakeholders
3232 appointed by the executive commissioner:
3333 (1) one representative of each organization that
3434 certifies mental health, intellectual or developmental disability,
3535 and substance use peer specialists in this state;
3636 (2) three representatives of organizations that
3737 employ mental health, intellectual or developmental disability,
3838 and substance use peer specialists;
3939 (3) one mental health peer specialist who works in an
4040 urban area;
4141 (4) one mental health peer specialist who works in a
4242 rural area;
4343 (5) one intellectual or developmental disability peer
4444 specialist who works in an urban area;
4545 (6) one intellectual or developmental disability peer
4646 specialist who works in a rural area;
4747 (7) one substance use peer specialist who works in an
4848 urban area;
4949 (8) [(6)] one substance use peer specialist who works
5050 in a rural area;
5151 (9) [(7)] one person who trains mental health peer
5252 specialists;
5353 (10) one person who trains intellectual or
5454 developmental disability peer specialists;
5555 (11) [(8)] one person who trains substance use peer
5656 specialists;
5757 (12) [(9)] three representatives of mental health and
5858 addiction licensed health care professional groups who supervise
5959 mental health, intellectual or developmental disability, and
6060 substance use peer specialists;
6161 (13) [(10)] to the extent possible, not more than
6262 three persons with personal experience recovering from mental
6363 illness, substance use conditions, or co-occurring mental illness
6464 and substance use conditions or with personal experience living
6565 with an intellectual or developmental disability; and
6666 (14) [(11)] any other persons considered appropriate
6767 by the executive commissioner.
6868 SECTION 2. As soon as practicable after the effective date
6969 of this Act, the executive commissioner of the Health and Human
7070 Services Commission shall adopt rules as necessary to implement the
7171 changes in law made by this Act.
7272 SECTION 3. This Act takes effect September 1, 2019.
