6	6	AN ACT
7	7	relating to notice by certain managed care entities of changes to
8	8	reimbursement amounts applicable to certain physicians and health
9	9	care providers.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. The heading to Chapter 1453, Insurance Code, is
12	12	amended to read as follows:
13	13	CHAPTER 1453. DISCLOSURE OF REIMBURSEMENT GUIDELINES AND AMOUNTS
14	14	UNDER MANAGED CARE PLAN
15	15	SECTION 2. Section 1453.001, Insurance Code, is amended by
16	16	adding Subdivision (4) to read as follows:
17	17	(4) "Physician" means an individual licensed to
18	18	practice medicine in this or another state.
19	19	SECTION 3. Chapter 1453, Insurance Code, is amended by
20	20	adding Section 1453.004 to read as follows:
21	21	Sec. 1453.004. NOTICE OF CHANGE TO REIMBURSEMENT AMOUNT.
22	22	(a) A managed care entity shall provide to each physician and
23	23	health care provider under contract with the managed care entity
24	24	notice of any change to a reimbursement amount that will be paid to
25	25	the physician or health care provider for a good or service provided
26	26	by the physician or health care provider. The notice must be
27	27	provided before the effective date of the change.
28	28	(b) The notice required by this section must be sent:
29	29	(1) directly to each physician or health care provider
30	30	that may be affected by the reimbursement amount change; and
31	31	(2) in a manner that is trackable and indicates the
32	32	date and time the notice was sent, including:
33	33	(A) by certified mail, return receipt requested,
34	34	to the physician's or provider's address; or
35	35	(B) by e-mail to an e-mail address specified by
36	36	the physician or provider.
37	37	SECTION 4. This Act takes effect September 1, 2019.
