66 AN ACT
77 relating to notice by certain managed care entities of changes to
88 reimbursement amounts applicable to certain physicians and health
99 care providers.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. The heading to Chapter 1453, Insurance Code, is
1212 amended to read as follows:
1313 CHAPTER 1453. DISCLOSURE OF REIMBURSEMENT GUIDELINES AND AMOUNTS
1414 UNDER MANAGED CARE PLAN
1515 SECTION 2. Section 1453.001, Insurance Code, is amended by
1616 adding Subdivision (4) to read as follows:
1717 (4) "Physician" means an individual licensed to
1818 practice medicine in this or another state.
1919 SECTION 3. Chapter 1453, Insurance Code, is amended by
2020 adding Section 1453.004 to read as follows:
2121 Sec. 1453.004. NOTICE OF CHANGE TO REIMBURSEMENT AMOUNT.
2222 (a) A managed care entity shall provide to each physician and
2323 health care provider under contract with the managed care entity
2424 notice of any change to a reimbursement amount that will be paid to
2525 the physician or health care provider for a good or service provided
2626 by the physician or health care provider. The notice must be
2727 provided before the effective date of the change.
2828 (b) The notice required by this section must be sent:
2929 (1) directly to each physician or health care provider
3030 that may be affected by the reimbursement amount change; and
3131 (2) in a manner that is trackable and indicates the
3232 date and time the notice was sent, including:
3333 (A) by certified mail, return receipt requested,
3434 to the physician's or provider's address; or
3535 (B) by e-mail to an e-mail address specified by
3636 the physician or provider.
3737 SECTION 4. This Act takes effect September 1, 2019.
