66 AN ACT
77 relating to the use of promotoras and community health workers in
88 Medicaid managed care.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 533, Government Code, is
1111 amended by adding Section 533.032 to read as follows:
1212 Sec. 533.032. PROMOTORAS AND COMMUNITY HEALTH WORKERS. (a)
1313 In this section, "promotora" and "community health worker" have the
1414 meaning assigned by Section 48.001, Health and Safety Code.
1515 (b) The commission shall allow each managed care
1616 organization that contracts with the commission to provide health
1717 care services to recipients under the STAR Medicaid managed care
1818 program to categorize services provided by a promotora or community
1919 health worker as a quality improvement cost instead of an
2020 administrative expense.
2121 SECTION 2. If before implementing any provision of this Act
2222 a state agency determines that a waiver or authorization from a
2323 federal agency is necessary for implementation of that provision,
2424 the agency affected by the provision shall request the waiver or
2525 authorization and may delay implementing that provision until the
2626 waiver or authorization is granted.
2727 SECTION 3. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2019.
