| 7 | 7 | | relating to the use of promotoras and community health workers in |

| 8 | 8 | | Medicaid managed care. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 533, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 533.032 to read as follows: |
|---|
| 12 | 12 | | Sec. 533.032. PROMOTORAS AND COMMUNITY HEALTH WORKERS. (a) |
|---|
| 13 | 13 | | In this section, "promotora" and "community health worker" have the |
|---|
| 14 | 14 | | meaning assigned by Section 48.001, Health and Safety Code. |
|---|
| 15 | 15 | | (b) The commission shall allow each managed care |
|---|
| 16 | 16 | | organization that contracts with the commission to provide health |
|---|
| 17 | 17 | | care services to recipients under the STAR Medicaid managed care |
|---|
| 18 | 18 | | program to categorize services provided by a promotora or community |
|---|
| 19 | 19 | | health worker as a quality improvement cost instead of an |
|---|
| 20 | 20 | | administrative expense. |
|---|
| 21 | 21 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 22 | 22 | | a state agency determines that a waiver or authorization from a |
|---|
| 23 | 23 | | federal agency is necessary for implementation of that provision, |
|---|
| 24 | 24 | | the agency affected by the provision shall request the waiver or |
|---|
| 25 | 25 | | authorization and may delay implementing that provision until the |
|---|
| 26 | 26 | | waiver or authorization is granted. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2019. |
