115 A BILL TO BE ENTITLED
126 AN ACT
137 relating to continuing education training on civil process for
148 constables.
159 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1610 SECTION 1. Section 1701.3545, Occupations Code, is amended
17- by amending Subsections (a), (b), and (f) and adding Subsection
18- (b-1) to read as follows:
19- (a) A public institution of higher education selected by the
20- commission shall establish and offer a program of initial training
21- and a program of continuing education for constables. The
22- curriculum for each program must relate to law enforcement
23- management [and civil process issues]. The institution selected
24- under this subsection shall develop the curriculum for the
25- programs. The curriculum must be approved by the commission.
26- (b) Each constable must complete at least 40 hours of
27- continuing education provided by the selected institution under
28- Subsection (a) [this section] each 48-month period. The commission
29- by rule shall establish a uniform 48-month continuing education
30- training period.
11+ by adding Subsection (b-1) and amending Subsections (e) and (f) to
12+ read as follows:
3113 (b-1) In addition to the requirements of Subsection (b),
32- during each 48-month continuing education training period each
33- constable must complete at least 20 hours of continuing education
34- instruction on civil process to be provided by a public institution
35- of higher education selected by the commission under this
36- subsection. The commission shall establish minimum curriculum

15+ education instruction on civil process as part of the continuing
16+ education program provided by the selected institution under this
17+ section during each 48-month continuing education training period.
18+ The commission by rule shall establish minimum curriculum
3719 requirements for the continuing education course on civil process
3820 required by this subsection. The commission may waive the
3921 continuing education requirements of this subsection if:
4022 (1) a constable requests a waiver because of hardship;
4123 and
4224 (2) the commission determines that a hardship exists.
25+ (e) The institution selected under Subsection (a) by rule
26+ may provide for the waiver of:
27+ (1) all or part of the required 40 hours of initial
28+ training for new constables to the extent the new constable has
29+ satisfactorily completed equivalent training during the 24 months
30+ preceding the individual's appointment or election; or
31+ (2) the continuing education requirements of
32+ Subsection (b) or (b-1) for an individual who has satisfactorily
33+ completed equivalent continuing education during the preceding 24
34+ months.
4335 (f) An individual who is subject to the continuing education
4436 requirements of Subsections [Subsection] (b) and (b-1) is exempt
4537 from other continuing education requirements under this
4638 subchapter.
47- SECTION 2. This Act takes effect September 1, 2019.

39+ SECTION 2. As soon as practicable after the effective date
40+ of this Act, the Texas Commission on Law Enforcement shall adopt
41+ rules necessary to implement Section 1701.3545, Occupations Code,
42+ as amended by this Act.
43+ SECTION 3. This Act takes effect September 1, 2019.
