55 AN ACT
66 relating to the administration of a medication, immunization, or
77 vaccination by a pharmacist.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. The heading to Section 554.004, Occupations
1010 Code, is amended to read as follows:
1111 Sec. 554.004. ADMINISTRATION OF MEDICATION, IMMUNIZATION,
1212 OR VACCINATION.
1313 SECTION 2. Section 554.004(a), Occupations Code, is amended
1414 to read as follows:
1515 (a) The board shall specify conditions under which a
1616 pharmacist may administer medication, including an immunization or
1717 [and] vaccination. The conditions for the administration of an
1818 immunization or vaccination must ensure that:
1919 (1) [a licensed health care provider authorized to
2020 administer the medication is not reasonably available to administer
2121 the medication;
2222 [(2) failure to administer the medication, other than an
2323 immunization or vaccination, might result in a significant delay or
2424 interruption of a critical phase of drug therapy;
2525 [(3)] the pharmacist possesses the necessary skill,
2626 education, and certification as specified by the board to
2727 administer the immunization or vaccination [medication];
2828 (2) [(4)] within a reasonable time after administering
2929 an immunization or vaccination [medication], the pharmacist
3030 notifies the licensed health care provider responsible for the
3131 patient's care that the immunization or vaccination [medication]
3232 was administered;
3333 (3) [(5)] the pharmacist may not administer an immunization
3434 or vaccination [medication] to a patient at the patient's
3535 residence, except at a licensed nursing home or hospital;
3636 (4) [(6)] the pharmacist administers an immunization or
3737 vaccination under a physician's written protocol and meets the
3838 standards established by the board; and
3939 (5) [(7)] the authority of a pharmacist to administer an
4040 immunization or vaccination [medication] may not be delegated.
4141 SECTION 3. Sections 554.052(a) and (c-1), Occupations Code,
4242 are amended to read as follows:
4343 (a) The board by rule shall require a pharmacist to notify a
4444 physician who prescribes an immunization or vaccination [within 24
4545 hours] after the pharmacist administers the immunization or
4646 vaccination. The physician shall prescribe the period for
4747 providing notice and the form of the notice in the physician's
4848 written protocol. The period for providing notice may not be later
4949 than the 14th day after the date the immunization or vaccination is
5050 administered.
5151 (c-1) A pharmacist may administer [an influenza
5252 vaccination] an immunization or vaccination to a patient who is at
5353 least [over] seven years of age without an established
5454 physician-patient relationship.
5555 SECTION 4. This Act takes effect September 1, 2019.
