46 AN ACT
57 relating to the exclusion from total revenue of certain payments
68 made by a performing rights society for purposes of computing the
79 franchise tax.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 171.1011, Tax Code, is amended by adding
1012 Subsection (g-12) to read as follows:
1113 (g-12) A taxable entity that is a performing rights society
1214 that licenses the public performance of nondramatic musical works
1315 on behalf of a copyright owner shall exclude from its total revenue,
1416 to the extent included under Subsection (c)(1)(A), (c)(2)(A), or
1517 (c)(3), payments made to the public performance rights holder and
1618 the copyright owner for whom the taxable entity licenses the public
1719 performance.
1820 SECTION 2. This Act takes effect immediately if it receives
1921 a vote of two-thirds of all the members elected to each house, as
2022 provided by Section 39, Article III, Texas Constitution. If this
2123 Act does not receive the vote necessary for immediate effect, this
2224 Act takes effect September 1, 2019.
