| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 25.01, Alcoholic Beverage Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 25.01. AUTHORIZED ACTIVITIES. The holder of a wine and |
|---|
| 13 | 13 | | beer retailer's permit may sell: |
|---|
| 14 | 14 | | (1) for consumption on or off the premises where sold, |
|---|
| 15 | 15 | | but not for resale, wine, beer, and malt liquors containing alcohol |
|---|
| 16 | 16 | | in excess of one-half of one percent by volume and not more than 17 |
|---|
| 17 | 17 | | percent by volume; and |
|---|
| 18 | 18 | | (2) for consumption on the premises, the following |
|---|
| 19 | 19 | | beverages [traditional port or sherry] containing alcohol in excess |
|---|
| 20 | 20 | | of one-half of one percent by volume and not more than 24 percent by |
|---|
| 21 | 21 | | volume: |
|---|
| 22 | 22 | | (A) traditional port or sherry; |
|---|
| 23 | 23 | | (B) dessert-flavored wine; or |
|---|
| 24 | 24 | | (C) rice wine. |

| 25 | 25 | | SECTION 2. Section 28.01(c), Alcoholic Beverage Code, is |

| 26 | 26 | | amended to read as follows: |

| 27 | 27 | | (c) The holder of a mixed beverage permit may also: |
|---|
| 28 | 28 | | (1) purchase wine, beer, ale, and malt liquor |
|---|
| 29 | 29 | | containing alcohol of not more than 24 [21] percent by volume in |
|---|
| 30 | 30 | | containers of any legal size from any permittee or licensee |
|---|
| 31 | 31 | | authorized to sell those beverages for resale; and |
|---|
| 32 | 32 | | (2) sell the wine, beer, ale, and malt liquor for |
|---|
| 33 | 33 | | consumption on the licensed premises. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2019. |
