77 relating to the sale of certain wine by the holder of a wine and beer
88 retailer's permit or mixed beverage permit.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 25.01, Alcoholic Beverage Code, is
1111 amended to read as follows:
1212 Sec. 25.01. AUTHORIZED ACTIVITIES. The holder of a wine and
1313 beer retailer's permit may sell:
1414 (1) for consumption on or off the premises where sold,
1515 but not for resale, wine, beer, and malt liquors containing alcohol
1616 in excess of one-half of one percent by volume and not more than 17
1717 percent by volume; and
1818 (2) for consumption on the premises, the following
1919 beverages [traditional port or sherry] containing alcohol in excess
2020 of one-half of one percent by volume and not more than 24 percent by
2121 volume:
2222 (A) traditional port or sherry;
2323 (B) dessert-flavored wine; or
2424 (C) rice wine.
2525 SECTION 2. Section 28.01(c), Alcoholic Beverage Code, is
2626 amended to read as follows:
2727 (c) The holder of a mixed beverage permit may also:
2828 (1) purchase wine, beer, ale, and malt liquor
2929 containing alcohol of not more than 24 [21] percent by volume in
3030 containers of any legal size from any permittee or licensee
3131 authorized to sell those beverages for resale; and
3232 (2) sell the wine, beer, ale, and malt liquor for
3333 consumption on the licensed premises.
3434 SECTION 3. This Act takes effect September 1, 2019.
