66 AN ACT
77 relating to certain requirements for designation as a qualified
88 business under the enterprise zone program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2303.401, Government Code, is amended to
1111 read as follows:
1212 Sec. 2303.401. DEFINITIONS. In this subchapter:
1313 (1) "New permanent job" means any [a] new employment
1414 position, regardless of title, that:
1515 (A) is created by a qualified business as
1616 described by Section 2303.402 at the qualified business site not
1717 earlier than the 90th day before the date the business's project or
1818 activity is designated as an enterprise project under this chapter;
1919 (B) will provide or has provided for the duration
2020 of the project's designation period at least 1,820 hours of
2121 employment a year to a qualified employee; and
2222 (C) will exist or has existed at the qualified
2323 business site for [the longer of]:
2424 (i) the duration of the project's
2525 designation period; or
2626 (ii) three years after the date on which a
2727 state benefit is received as authorized by this chapter.
2828 (2) "Retained job" means any employment position,
2929 regardless of title, [a job] that:
3030 (A) existed with a qualified business on the 91st
3131 day before the date the business's project or activity is
3232 designated as an enterprise project;
3333 (B) has provided and will continue to provide
3434 employment to a qualified employee of at least 1,820 hours
3535 annually; and
3636 (C) will be or has been an employment position
3737 for [the longer of]:
3838 (i) the duration of the project's
3939 designation period; or
4040 (ii) three years after the expiration date
4141 of the claim period for receipt of a state benefit authorized by
4242 this chapter.
4343 SECTION 2. Section 2303.402(a), Government Code, is amended
4444 to read as follows:
4545 (a) A person is a qualified business if the bank, for the
4646 purpose of state benefits under this chapter, or the nominating
4747 body of a project or activity of the person under this chapter, for
4848 the purpose of local incentives, certifies that:
4949 (1) the person is engaged in or has provided
5050 substantial commitment to initiate the active conduct of a trade or
5151 business in an enterprise zone, and at least 25 percent of the
5252 person's new permanent jobs in the enterprise zone are held by:
5353 (A) residents of any enterprise zone in this
5454 state;
5555 (B) economically disadvantaged individuals; [or]
5656 (C) veterans; or
5757 (D) residents of any area in this state
5858 designated by the federal government as an opportunity zone; or
5959 (2) the person is engaged in or has provided
6060 substantial commitment to initiate the active conduct of a trade or
6161 business in an area of this state that does not qualify as an
6262 enterprise zone, and at least 35 percent of the person's new
6363 permanent jobs at the qualified business site are held by:
6464 (A) residents of any enterprise zone in this
6565 state;
6666 (B) individuals who are economically
6767 disadvantaged; [or]
6868 (C) veterans; or
6969 (D) residents of any area in this state
7070 designated by the federal government as an opportunity zone.
7171 SECTION 3. The changes in law made by this Act apply only to
7272 an application for an enterprise project designation under the
7373 enterprise zone program established under Chapter 2303, Government
7474 Code, as amended by this Act, that is submitted on or after the
7575 effective date of this Act. An application for an enterprise
7676 project designation under the enterprise zone program that is
7777 submitted before the effective date of this Act is governed by the
7878 law in effect on the date the application was submitted, and the
7979 former law is continued in effect for that purpose.
8080 SECTION 4. This Act takes effect September 1, 2019.
