87 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
98 SECTION 1. Subchapter C, Chapter 361, Health and Safety
109 Code, is amended by adding Section 361.0851 to read as follows:
1110 Sec. 361.0851. FINANCIAL ASSURANCE REQUIREMENTS FOR USED
1211 AND SCRAP TIRE HANDLERS. (a) In this section, "scrap tire" has the
1312 meaning assigned by Section 361.112.
1413 (b) This section does not apply to a registered used or
1514 scrap tire processor using tires for energy recovery at an on-site
1615 cement kiln or other energy recovery facility identified by
1716 commission rule.
1817 (c) The commission shall require a bond or other financial
1918 assurance as a condition of issuing a registration for the
2019 transportation, storage, or processing of scrap tires. The amount
2120 of the bond or other financial assurance required must be
2221 sufficient to cover the reasonable expenses of an immediate
2322 remedial or removal action under Section 361.1125.
2423 SECTION 2. Section 361.112, Health and Safety Code, is
2524 amended by adding Subsections (o) and (p) to read as follows:
2625 (o) The commission shall require a used or scrap tire
2726 transporter to submit to the commission an annual report on the
2827 records maintained by the transporter under this section. A used or
2928 scrap tire transporter who fails to submit an annual report under
3029 this subsection is not eligible to receive a registration insignia
3130 under Subsection (p).
3231 (p) The commission shall annually issue a registration
3332 insignia to each used or scrap tire transporter. The used or scrap
3433 tire transporter shall display the insignia on each vehicle used to
3534 transport tires under the registration. The insignia expires
3635 annually on a date specified by the commission. The commission may
3736 adopt rules for issuing duplicate and multiple insignia.
3837 SECTION 3. This Act takes effect September 1, 2019.
