55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requirements for certain charter entities to contract
88 with a school district to operate a district campus.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 11.174, Education Code, is amended by
1111 adding Subsections (a-1), (c-1), and (c-2) and amending Subsection
1212 (c) to read as follows:
1313 (a-1) If a campus intervention team has been assigned to a
1414 campus, the board of trustees of a school district may not enter
1515 into a contract under Subsection (a) for the operation of that
1616 campus until the campus intervention team has completed the
1717 responsibilities assigned under Subchapter B, Chapter 39A,
1818 including:
1919 (1) performing an on-site needs assessment;
2020 (2) recommending actions relating to insufficient
2121 performance of the campus; and
2222 (3) developing a targeted improvement plan and
2323 submitting the plan to the commissioner.
2424 (c) Not later than 30 days before the date a school district
2525 enters [Before entering] into a contract as provided by this
2626 section, a school district shall seek the advice and opinion of
2727 [must consult with] campus personnel regarding the provisions to be
2828 included in the contract between the school district and the
2929 open-enrollment charter school. A school district must obtain and
3030 retain in the district's records a document signed by all campus
3131 personnel certifying that campus personnel was consulted in
3232 accordance with this subsection.
3333 (c-1) A contract entered into between a school district and
3434 an open-enrollment charter school under this section:
3535 (1) may not affect any [All] rights or [and]
3636 protections afforded by:
3737 (A) current employment contracts or agreements;
3838 or
3939 (B) Chapter 21 or 22;
4040 (2) must provide that the campus will not be subject to
4141 a reduction in personnel as a result of the contract; and
4242 (3) must be published on the district's Internet
4343 website not later than 30 days before the date the board of trustees
4444 votes to adopt the contract [may not be affected by the contract
4545 entered into between a school district and an open-enrollment
4646 charter school under this section].
4747 (c-2) Before a contract between a school district and an
4848 open-enrollment charter school may be adopted by the board of
4949 trustees of a school district under this section:
5050 (1) the district must submit the contract to the
5151 parents or guardians of the students enrolled at the affected
5252 campus for approval; and
5353 (2) the contract must be approved by at least 75
5454 percent of the parents or guardians of students enrolled during the
5555 current school year at the campus.
5656 SECTION 2. This Act applies beginning with the 2019-2020
5757 school year.
5858 SECTION 3. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2019.
