| 8 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 14 | | SECTION 1. Section 254.041, Election Code, is amended by |
|---|
| 10 | 15 | | amending Subsection (b) and adding Subsection (b-1) to read as |
|---|
| 11 | 16 | | follows: |
|---|
| 12 | 17 | | (b) Except as provided by Subsections (b-1) and |
|---|
| 13 | 18 | | [Subsection] (c), an offense under this section is a Class C |
|---|
| 14 | 19 | | misdemeanor. |
|---|
| 15 | 20 | | (b-1) A violation of Subsection (a)(1) is a Class B |
|---|
| 16 | 21 | | misdemeanor if it is shown on the trial of the offense that the |
|---|
| 17 | 22 | | person knowingly failed to file three or more consecutive reports |
|---|
| 18 | 23 | | under this chapter on time. |

| 19 | 24 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 20 | 25 | | a report required to be filed under Chapter 254, Election Code, on |
|---|
| 21 | 26 | | or after the effective date of this Act. A report required to be |
|---|
| 22 | 27 | | filed before the effective date of this Act is subject to the law in |
|---|
| 23 | 28 | | effect at the time the report was filed, and the former law is |
|---|
| 24 | 29 | | continued in effect for that purpose. |

| 25 | 30 | | SECTION 3. This Act takes effect September 1, 2019. |
