65 AN ACT
76 relating to notice regarding voting by physicians at certain
87 entities to authorize the differentiation of physicians based on
98 maintenance of certification.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. Subchapter E, Chapter 241, Health and Safety
1211 Code, is amended by adding Section 241.1011 to read as follows:
1312 Sec. 241.1011. HOSPITAL AUTHORITY TO DIFFERENTIATE BASED ON
1413 MAINTENANCE OF CERTIFICATION. An entity to which Section 151.0515,
1514 Occupations Code, applies violates this chapter if the entity does
1615 not comply with the requirements of Section 151.0515(c-1),
1716 Occupations Code, regarding the provision of written notice
1817 regarding the ability to vote on the entity's differentiation
1918 between physicians based on a physician's maintenance of
2019 certification.
2120 SECTION 2. Section 151.0515, Occupations Code, is amended
2221 by adding Subsection (c-1) to read as follows:
2322 (c-1) An entity described by Subsection (a) shall provide
2423 written notice to the voting physician members of the entity's
2524 organized medical staff of the process by which the members may vote
2625 on the entity's differentiation between physicians based on a
2726 physician's maintenance of certification. The notice must:
2827 (1) state that any vote must comply with:
2928 (A) the normal voting process of the entity and
3029 the entity's organized medical staff; and
3130 (B) any applicable law, regulation, or
3231 accreditation requirement; and
3332 (2) be provided:
3433 (A) at least once each calendar year; and
3534 (B) in a form acceptable to the entity and the
3635 entity's organized medical staff for a similar notification, which
3736 may include in electronic form.
3837 SECTION 3. This Act takes effect September 1, 2019.
