| 10 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 10 | | SECTION 1. Subchapter E, Chapter 241, Health and Safety |
|---|
| 12 | 11 | | Code, is amended by adding Section 241.1011 to read as follows: |
|---|
| 13 | 12 | | Sec. 241.1011. HOSPITAL AUTHORITY TO DIFFERENTIATE BASED ON |
|---|
| 14 | 13 | | MAINTENANCE OF CERTIFICATION. An entity to which Section 151.0515, |
|---|
| 15 | 14 | | Occupations Code, applies violates this chapter if the entity does |
|---|
| 16 | 15 | | not comply with the requirements of Section 151.0515(c-1), |
|---|
| 17 | 16 | | Occupations Code, regarding the provision of written notice |
|---|
| 18 | 17 | | regarding the ability to vote on the entity's differentiation |
|---|
| 19 | 18 | | between physicians based on a physician's maintenance of |
|---|
| 20 | 19 | | certification. |
|---|
| 21 | 20 | | SECTION 2. Section 151.0515, Occupations Code, is amended |
|---|
| 22 | 21 | | by adding Subsection (c-1) to read as follows: |
|---|
| 23 | 22 | | (c-1) An entity described by Subsection (a) shall provide |
|---|
| 24 | 23 | | written notice to the voting physician members of the entity's |
|---|
| 25 | 24 | | organized medical staff of the process by which the members may vote |
|---|
| 26 | 25 | | on the entity's differentiation between physicians based on a |
|---|
| 27 | 26 | | physician's maintenance of certification. The notice must: |
|---|
| 28 | 27 | | (1) state that any vote must comply with: |
|---|
| 29 | 28 | | (A) the normal voting process of the entity and |
|---|
| 30 | 29 | | the entity's organized medical staff; and |
|---|
| 31 | 30 | | (B) any applicable law, regulation, or |
|---|
| 32 | 31 | | accreditation requirement; and |
|---|
| 33 | 32 | | (2) be provided: |
|---|
| 34 | 33 | | (A) at least once each calendar year; and |
|---|
| 35 | 34 | | (B) in a form acceptable to the entity and the |
|---|
| 36 | 35 | | entity's organized medical staff for a similar notification, which |
|---|
| 37 | 36 | | may include in electronic form. |
|---|
| 38 | 37 | | SECTION 3. This Act takes effect September 1, 2019. |
