| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 531.0997 to read as follows: |
|---|
| 12 | 12 | | Sec. 531.0997. AUTOMATIC ENROLLMENT OF CERTAIN WOMEN IN |
|---|
| 13 | 13 | | HEALTHY TEXAS WOMEN PROGRAM. (a) In this section, "Healthy Texas |
|---|
| 14 | 14 | | Women program" means a program operated by the commission that is |
|---|
| 15 | 15 | | substantially similar to the demonstration project operated under |
|---|
| 16 | 16 | | former Section 32.0248, Human Resources Code, and that is intended |
|---|
| 17 | 17 | | to expand access to preventive health and family planning services |
|---|
| 18 | 18 | | for women in this state. |
|---|
| 19 | 19 | | (b) Subject to the eligibility requirements of the Healthy |
|---|
| 20 | 20 | | Texas Women program, the commission shall identify and |
|---|
| 21 | 21 | | automatically enroll in the program a woman who is a Medicaid |
|---|
| 22 | 22 | | recipient or enrollee in the child health plan program but who will |
|---|
| 23 | 23 | | lose eligibility for benefits under the applicable program because |
|---|
| 24 | 24 | | of the woman's age. The commission shall implement the automatic |
|---|
| 25 | 25 | | enrollment in a manner that: |
|---|
| 26 | 26 | | (1) ensures a seamless transition in the provision of |
|---|
| 27 | 27 | | services between Medicaid or the child health plan program, as |
|---|
| 28 | 28 | | applicable, and the Healthy Texas Women program; and |
|---|
| 29 | 29 | | (2) allows a woman to begin receiving services through |
|---|
| 30 | 30 | | the Healthy Texas Women program on the first day the woman is no |
|---|
| 31 | 31 | | longer eligible for Medicaid or the child health plan program, as |
|---|
| 32 | 32 | | applicable. |
|---|
| 33 | 33 | | (c) The executive commissioner shall adopt rules necessary |
|---|
| 34 | 34 | | to implement this section. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect September 1, 2020. |
