55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a trauma-informed care policy for school districts and
88 open-enrollment charter schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 11.252(a), Education Code, is amended to
1111 read as follows:
1212 (a) Each school district shall have a district improvement
1313 plan that is developed, evaluated, and revised annually, in
1414 accordance with district policy, by the superintendent with the
1515 assistance of the district-level committee established under
1616 Section 11.251. The purpose of the district improvement plan is to
1717 guide district and campus staff in the improvement of student
1818 performance for all student groups in order to attain state
1919 standards in respect to the achievement indicators adopted under
2020 Section 39.053(c). The district improvement plan must include
2121 provisions for:
2222 (1) a comprehensive needs assessment addressing
2323 district student performance on the achievement indicators, and
2424 other appropriate measures of performance, that are disaggregated
2525 by all student groups served by the district, including categories
2626 of ethnicity, socioeconomic status, sex, and populations served by
2727 special programs, including students in special education programs
2828 under Subchapter A, Chapter 29;
2929 (2) measurable district performance objectives for
3030 all appropriate achievement indicators for all student
3131 populations, including students in special education programs
3232 under Subchapter A, Chapter 29, and other measures of student
3333 performance that may be identified through the comprehensive needs
3434 assessment;
3535 (3) strategies for improvement of student performance
3636 that include:
3737 (A) instructional methods for addressing the
3838 needs of student groups not achieving their full potential;
3939 (B) methods for addressing the needs of students
4040 for special programs, including:
4141 (i) suicide prevention programs, in
4242 accordance with Subchapter O-1, Chapter 161, Health and Safety
4343 Code, which includes a parental or guardian notification procedure;
4444 (ii) conflict resolution programs;
4545 (iii) violence prevention programs; and
4646 (iv) dyslexia treatment programs;
4747 (C) dropout reduction;
4848 (D) integration of technology in instructional
4949 and administrative programs;
5050 (E) discipline management;
5151 (F) staff development for professional staff of
5252 the district;
5353 (G) career education to assist students in
5454 developing the knowledge, skills, and competencies necessary for a
5555 broad range of career opportunities; and
5656 (H) accelerated education;
5757 (4) strategies for providing to middle school, junior
5858 high school, and high school students, those students' teachers and
5959 school counselors, and those students' parents information about:
6060 (A) higher education admissions and financial
6161 aid opportunities;
6262 (B) the TEXAS grant program and the Teach for
6363 Texas grant program established under Chapter 56;
6464 (C) the need for students to make informed
6565 curriculum choices to be prepared for success beyond high school;
6666 and
6767 (D) sources of information on higher education
6868 admissions and financial aid;
6969 (5) resources needed to implement identified
7070 strategies;
7171 (6) staff responsible for ensuring the accomplishment
7272 of each strategy;
7373 (7) timelines for ongoing monitoring of the
7474 implementation of each improvement strategy;
7575 (8) formative evaluation criteria for determining
7676 periodically whether strategies are resulting in intended
7777 improvement of student performance; [and]
7878 (9) the policy under Section 38.0041 addressing sexual
7979 abuse and other maltreatment of children; and
8080 (10) the trauma-informed care policy under Section
8181 38.036.
8282 SECTION 2. Subchapter A, Chapter 38, Education Code, is
8383 amended by adding Section 38.036 to read as follows:
8484 Sec. 38.036. TRAUMA-INFORMED CARE POLICY. (a) Each school
8585 district and open-enrollment charter school shall adopt and
8686 implement a policy requiring the integration of trauma-informed
8787 practices in each school environment. A district must include the
8888 policy in the district improvement plan required under Section
8989 11.252.
9090 (b) A policy required by this section must address:
9191 (1) using resources developed by the agency, methods
9292 for:
9393 (A) increasing staff and parent awareness of
9494 trauma-informed care; and
9595 (B) implementation of trauma-informed practices
9696 and care by district and campus staff; and
9797 (2) available counseling options for students
9898 affected by trauma or grief.
9999 (c) The methods under Subsection (b)(1) for increasing
100100 awareness and implementation of trauma-informed care must include
101101 training as provided by this subsection. The training:
102102 (1) must be provided:
103103 (A) through a program selected from the list of
104104 recommended best practice-based programs and research-based
105105 practices established under Section 161.325, Health and Safety
106106 Code; and
107107 (B) as part of any new employee orientation for
108108 all new school district and open-enrollment charter school
109109 educators; and
110110 (2) may be:
111111 (A) provided annually to all school district or
112112 open-enrollment charter school employees; and
113113 (B) included in staff development under Section
114114 21.451.
115115 (d) For any training under Subsection (c), each school
116116 district and open-enrollment charter school shall maintain records
117117 that include the name of each district or charter school staff
118118 member who participated in the training.
119119 (e) If a school district or open-enrollment charter school
120120 determines that the district or charter school does not have
121121 sufficient resources to provide the training required under
122122 Subsection (c), the district or charter school may partner with a
123123 community mental health organization to provide training that meets
124124 the requirements of Subsection (c) at no cost to the district or
125125 charter school.
126126 (f) The commissioner shall adopt rules as necessary to
127127 administer this section.
128128 SECTION 3. This Act applies beginning with the 2019-2020
129129 school year.
130130 SECTION 4. This Act takes effect immediately if it receives
131131 a vote of two-thirds of all the members elected to each house, as
132132 provided by Section 39, Article III, Texas Constitution. If this
133133 Act does not receive the vote necessary for immediate effect, this
134134 Act takes effect September 1, 2019.
