7 | 7 | | relating to a trauma-informed care policy for school districts and |
---|
8 | 8 | | open-enrollment charter schools. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 11.252(a), Education Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | (a) Each school district shall have a district improvement |
---|
13 | 13 | | plan that is developed, evaluated, and revised annually, in |
---|
14 | 14 | | accordance with district policy, by the superintendent with the |
---|
15 | 15 | | assistance of the district-level committee established under |
---|
16 | 16 | | Section 11.251. The purpose of the district improvement plan is to |
---|
17 | 17 | | guide district and campus staff in the improvement of student |
---|
18 | 18 | | performance for all student groups in order to attain state |
---|
19 | 19 | | standards in respect to the achievement indicators adopted under |
---|
20 | 20 | | Section 39.053(c). The district improvement plan must include |
---|
21 | 21 | | provisions for: |
---|
22 | 22 | | (1) a comprehensive needs assessment addressing |
---|
23 | 23 | | district student performance on the achievement indicators, and |
---|
24 | 24 | | other appropriate measures of performance, that are disaggregated |
---|
25 | 25 | | by all student groups served by the district, including categories |
---|
26 | 26 | | of ethnicity, socioeconomic status, sex, and populations served by |
---|
27 | 27 | | special programs, including students in special education programs |
---|
28 | 28 | | under Subchapter A, Chapter 29; |
---|
29 | 29 | | (2) measurable district performance objectives for |
---|
30 | 30 | | all appropriate achievement indicators for all student |
---|
31 | 31 | | populations, including students in special education programs |
---|
32 | 32 | | under Subchapter A, Chapter 29, and other measures of student |
---|
33 | 33 | | performance that may be identified through the comprehensive needs |
---|
34 | 34 | | assessment; |
---|
35 | 35 | | (3) strategies for improvement of student performance |
---|
36 | 36 | | that include: |
---|
37 | 37 | | (A) instructional methods for addressing the |
---|
38 | 38 | | needs of student groups not achieving their full potential; |
---|
39 | 39 | | (B) methods for addressing the needs of students |
---|
40 | 40 | | for special programs, including: |
---|
41 | 41 | | (i) suicide prevention programs, in |
---|
42 | 42 | | accordance with Subchapter O-1, Chapter 161, Health and Safety |
---|
43 | 43 | | Code, which includes a parental or guardian notification procedure; |
---|
44 | 44 | | (ii) conflict resolution programs; |
---|
45 | 45 | | (iii) violence prevention programs; and |
---|
46 | 46 | | (iv) dyslexia treatment programs; |
---|
47 | 47 | | (C) dropout reduction; |
---|
48 | 48 | | (D) integration of technology in instructional |
---|
49 | 49 | | and administrative programs; |
---|
50 | 50 | | (E) discipline management; |
---|
51 | 51 | | (F) staff development for professional staff of |
---|
52 | 52 | | the district; |
---|
53 | 53 | | (G) career education to assist students in |
---|
54 | 54 | | developing the knowledge, skills, and competencies necessary for a |
---|
55 | 55 | | broad range of career opportunities; and |
---|
56 | 56 | | (H) accelerated education; |
---|
57 | 57 | | (4) strategies for providing to middle school, junior |
---|
58 | 58 | | high school, and high school students, those students' teachers and |
---|
59 | 59 | | school counselors, and those students' parents information about: |
---|
60 | 60 | | (A) higher education admissions and financial |
---|
61 | 61 | | aid opportunities; |
---|
62 | 62 | | (B) the TEXAS grant program and the Teach for |
---|
63 | 63 | | Texas grant program established under Chapter 56; |
---|
64 | 64 | | (C) the need for students to make informed |
---|
65 | 65 | | curriculum choices to be prepared for success beyond high school; |
---|
66 | 66 | | and |
---|
67 | 67 | | (D) sources of information on higher education |
---|
68 | 68 | | admissions and financial aid; |
---|
69 | 69 | | (5) resources needed to implement identified |
---|
70 | 70 | | strategies; |
---|
71 | 71 | | (6) staff responsible for ensuring the accomplishment |
---|
72 | 72 | | of each strategy; |
---|
73 | 73 | | (7) timelines for ongoing monitoring of the |
---|
74 | 74 | | implementation of each improvement strategy; |
---|
75 | 75 | | (8) formative evaluation criteria for determining |
---|
76 | 76 | | periodically whether strategies are resulting in intended |
---|
77 | 77 | | improvement of student performance; [and] |
---|
78 | 78 | | (9) the policy under Section 38.0041 addressing sexual |
---|
79 | 79 | | abuse and other maltreatment of children; and |
---|
80 | 80 | | (10) the trauma-informed care policy under Section |
---|
81 | 81 | | 38.036. |
---|
82 | 82 | | SECTION 2. Subchapter A, Chapter 38, Education Code, is |
---|
83 | 83 | | amended by adding Section 38.036 to read as follows: |
---|
84 | 84 | | Sec. 38.036. TRAUMA-INFORMED CARE POLICY. (a) Each school |
---|
85 | 85 | | district and open-enrollment charter school shall adopt and |
---|
86 | 86 | | implement a policy requiring the integration of trauma-informed |
---|
87 | 87 | | practices in each school environment. A district must include the |
---|
88 | 88 | | policy in the district improvement plan required under Section |
---|
89 | 89 | | 11.252. |
---|
90 | 90 | | (b) A policy required by this section must address: |
---|
91 | 91 | | (1) using resources developed by the agency, methods |
---|
92 | 92 | | for: |
---|
93 | 93 | | (A) increasing staff and parent awareness of |
---|
94 | 94 | | trauma-informed care; and |
---|
95 | 95 | | (B) implementation of trauma-informed practices |
---|
96 | 96 | | and care by district and campus staff; and |
---|
97 | 97 | | (2) available counseling options for students |
---|
98 | 98 | | affected by trauma or grief. |
---|
99 | 99 | | (c) The methods under Subsection (b)(1) for increasing |
---|
100 | 100 | | awareness and implementation of trauma-informed care must include |
---|
101 | 101 | | training as provided by this subsection. The training: |
---|
102 | 102 | | (1) must be provided: |
---|
103 | 103 | | (A) through a program selected from the list of |
---|
104 | 104 | | recommended best practice-based programs and research-based |
---|
105 | 105 | | practices established under Section 161.325, Health and Safety |
---|
106 | 106 | | Code; and |
---|
107 | 107 | | (B) as part of any new employee orientation for |
---|
108 | 108 | | all new school district and open-enrollment charter school |
---|
109 | 109 | | educators; and |
---|
110 | 110 | | (2) may be: |
---|
111 | 111 | | (A) provided annually to all school district or |
---|
112 | 112 | | open-enrollment charter school employees; and |
---|
113 | 113 | | (B) included in staff development under Section |
---|
114 | 114 | | 21.451. |
---|
115 | 115 | | (d) For any training under Subsection (c), each school |
---|
116 | 116 | | district and open-enrollment charter school shall maintain records |
---|
117 | 117 | | that include the name of each district or charter school staff |
---|
118 | 118 | | member who participated in the training. |
---|
119 | 119 | | (e) If a school district or open-enrollment charter school |
---|
120 | 120 | | determines that the district or charter school does not have |
---|
121 | 121 | | sufficient resources to provide the training required under |
---|
122 | 122 | | Subsection (c), the district or charter school may partner with a |
---|
123 | 123 | | community mental health organization to provide training that meets |
---|
124 | 124 | | the requirements of Subsection (c) at no cost to the district or |
---|
125 | 125 | | charter school. |
---|
126 | 126 | | (f) The commissioner shall adopt rules as necessary to |
---|
127 | 127 | | administer this section. |
---|
128 | 128 | | SECTION 3. This Act applies beginning with the 2019-2020 |
---|
129 | 129 | | school year. |
---|
130 | 130 | | SECTION 4. This Act takes effect immediately if it receives |
---|
131 | 131 | | a vote of two-thirds of all the members elected to each house, as |
---|
132 | 132 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
133 | 133 | | Act does not receive the vote necessary for immediate effect, this |
---|
134 | 134 | | Act takes effect September 1, 2019. |
