55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the sharing of newborn and infant hearing screening
88 results and the provision of information to parents following a
99 screening.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 47.0031(b), Health and Safety Code, is
1212 amended to read as follows:
1313 (b) If a newborn or an infant does not pass the screening in
1414 a follow-up hearing screening, the program that performed the
1515 follow-up hearing screening on the newborn or infant shall:
1616 (1) provide the newborn's or infant's parents with the
1717 screening results;
1818 (2) with the prior written consent of the newborn's or
1919 infant's parents, provide the screening results to the primary
2020 statewide resource center established under Section 30.051,
2121 Education Code;
2222 (3) assist in scheduling a diagnostic audiological
2323 evaluation for the newborn or infant, consistent with the most
2424 current guidelines in the Joint Committee on Infant Hearing
2525 Position Statement, or refer the newborn or infant to a licensed
2626 audiologist who provides diagnostic audiological evaluations for
2727 newborns or infants that are consistent with the most current
2828 guidelines in the Joint Committee on Infant Hearing Position
2929 Statement; and
3030 (4) [(3)] refer the newborn or infant to early
3131 childhood intervention services and the primary statewide resource
3232 center established under Section 30.051, Education Code.
3333 SECTION 2. Section 47.005, Health and Safety Code, is
3434 amended by amending Subsections (a), (b), and (d) and adding
3535 Subsection (a-1) to read as follows:
3636 (a) A birthing facility that operates a program shall
3737 simultaneously distribute to the parents of each newborn or infant
3838 who is screened:
3939 (1) the screening results;
4040 (2) educational and informational materials that are
4141 standardized by the department regarding:
4242 (A) [screening results and] follow-up care; and
4343 (B) available public resources, including:
4444 (i) early childhood intervention services
4545 developed under Chapter 73, Human Resources Code;
4646 (ii) the primary statewide resource center
4747 established under Section 30.051, Education Code; and
4848 (iii) contact information for Texas Early
4949 Hearing Detection and Intervention.
5050 (a-1) The department shall make available to the public on
5151 request the educational and informational materials described by
5252 Subsection (a)(2).
5353 (b) A birthing facility that operates a program shall report
5454 screening results to:
5555 (1) the parents;
5656 (2) the newborn's or infant's attending physician,
5757 primary care physician, or other applicable health care provider;
5858 [and]
5959 (3) the department; and
6060 (4) the primary statewide resource center established
6161 under Section 30.051, Education Code.
6262 (d) The department may coordinate the diagnostic
6363 audiological evaluation required under Section 47.0031(b)(3)
6464 [47.0031(b)(2)]. A diagnostic audiological evaluation must be
6565 completed on the newborn or infant:
6666 (1) not later than the third month after the newborn's
6767 or infant's birth unless the newborn or infant has been
6868 hospitalized since birth; or
6969 (2) upon referral by the newborn's or infant's primary
7070 care physician or other applicable health care provider.
7171 SECTION 3. Sections 47.007(b) and (h), Health and Safety
7272 Code, are amended to read as follows:
7373 (b) Subject to Section 47.008, a qualified hearing
7474 screening provider, hospital, health care provider, physician,
7575 audiologist, or intervention specialist shall access the
7676 information management, reporting, and tracking system to provide
7777 information to the department and may obtain information from the
7878 department relating to:
7979 (1) the results of each hearing screening performed
8080 under Section 47.003(a) or 47.0031(a);
8181 (2) the results of each diagnostic audiological
8282 evaluation required under Section 47.0031(b)(3) [47.0031(b)(2)];
8383 (3) infants who receive follow-up care;
8484 (4) infants identified with hearing loss;
8585 (5) infants who are referred for intervention
8686 services; and
8787 (6) case level information necessary to report
8888 required statistics to:
8989 (A) the federal Maternal and Child Health Bureau
9090 on an annual basis; and
9191 (B) the federal Centers for Disease Control and
9292 Prevention.
9393 (h) Subject to Section 47.008, a qualified hearing
9494 screening provider, hospital, health care provider, physician,
9595 audiologist, or intervention specialist may obtain information
9696 from the department relating to:
9797 (1) the results of each hearing screening performed
9898 under Section 47.003(a) or 47.0031(a);
9999 (2) the results of each diagnostic audiological
100100 evaluation required under Section 47.0031(b)(3) [47.0031(b)(2)];
101101 (3) infants who receive follow-up care;
102102 (4) infants identified with hearing loss; and
103103 (5) infants who are referred for intervention
104104 services.
105105 SECTION 4. Section 47.008(c), Health and Safety Code, is
106106 amended to read as follows:
107107 (c) The executive commissioner by rule shall develop
108108 guidelines to protect the confidentiality of patients in accordance
109109 with Chapter 159, Occupations Code, and require the written consent
110110 of a parent or guardian of a patient before any individually
111111 identifying information is provided to the department or the
112112 primary statewide resource center established under Section
113113 30.051, Education Code, as set out in this chapter. The department
114114 and the primary statewide resource center shall permit a parent or
115115 guardian at any time to withdraw information provided to the
116116 department or center under this chapter.
117117 SECTION 5. As soon as practicable after the effective date
118118 of this Act, the executive commissioner of the Health and Human
119119 Services Commission shall adopt rules as necessary to implement the
120120 changes in law made by this Act.
121121 SECTION 6. This Act takes effect September 1, 2019.
