55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an exception from required disclosure under the public
88 information law for certain personal information obtained by
99 certain flood control districts.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 552, Government Code, is
1212 amended by adding Section 552.159 to read as follows:
1313 Sec. 552.159. EXCEPTION: CERTAIN PERSONAL INFORMATION
1414 OBTAINED BY FLOOD CONTROL DISTRICT. The following information
1515 obtained by a flood control district located in a county with a
1616 population of 3.3 million or more in connection with operations
1717 related to a declared disaster or flooding is excepted from the
1818 requirements of Section 552.021:
1919 (1) a person's name;
2020 (2) a home address;
2121 (3) a business address;
2222 (4) a home telephone number;
2323 (5) a mobile telephone number;
2424 (6) an electronic mail address;
2525 (7) social media account information; and
2626 (8) a social security number.
2727 SECTION 2. Section 552.159, Government Code, as added by
2828 this Act, applies only to a request for public information received
2929 on or after the effective date of this Act. A request received
3030 before that date is governed by the law in effect when the request
3131 was received, and the former law is continued in effect for that
3232 purpose.
3333 SECTION 3. This Act takes effect September 1, 2019.
