66 AN ACT
77 relating to required reporting of human trafficking cases by peace
88 officers and prosecutors.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 2, Code of Criminal Procedure, is
1111 amended by adding Article 2.305 to read as follows:
1212 Art. 2.305. REPORT REQUIRED CONCERNING HUMAN TRAFFICKING
1313 CASES. (a) This article applies only to a municipal police
1414 department, sheriff's department, constable's office, county
1515 attorney's office, district attorney's office, and criminal
1616 district attorney's office, as applicable, in a county with a
1717 population of more than 50,000.
1818 (b) A peace officer who investigates the alleged commission
1919 of an offense under Chapter 20A, Penal Code, shall prepare and
2020 submit to a university designated by the attorney general a written
2121 report that includes the following information:
2222 (1) the offense being investigated, including a brief
2323 description of the alleged prohibited conduct;
2424 (2) regarding each person suspected of the offense and
2525 each victim of the offense, the person's:
2626 (A) name;
2727 (B) age;
2828 (C) gender; and
2929 (D) race or ethnicity, as defined by Article
3030 2.132;
3131 (3) the date, time, and location of the alleged
3232 offense;
3333 (4) the type of human trafficking involved, including:
3434 (A) forced labor or services, as defined by
3535 Section 20A.01, Penal Code;
3636 (B) causing the victim by force, fraud, or
3737 coercion to engage in prohibited conduct involving one or more
3838 sexual activities, including conduct described by Section
3939 20A.02(a)(3), Penal Code; or
4040 (C) causing a child victim by any means to engage
4141 in, or become the victim of, prohibited conduct involving one or
4242 more sexual activities, including conduct described by Section
4343 20A.02(a)(7), Penal Code; and
4444 (5) the disposition of the investigation, regardless
4545 of the manner of disposition.
4646 (c) An attorney representing the state who prosecutes the
4747 alleged commission of an offense under Chapter 20A, Penal Code,
4848 shall prepare and submit to a university designated by the attorney
4949 general a written report that includes the following information:
5050 (1) the offense being prosecuted, including a brief
5151 description of the alleged prohibited conduct;
5252 (2) the information described by Subsections (b)(2),
5353 (3), and (4); and
5454 (3) the disposition of the prosecution, regardless of
5555 the manner of disposition.
5656 (d) The attorney general may prescribe:
5757 (1) the form and manner of submission of a report
5858 required by Subsection (b) or (c); and
5959 (2) additional information to include in a report
6060 required by Subsection (b) or (c).
6161 SECTION 2. This Act takes effect September 1, 2019.
