6	6	AN ACT
7	7	relating to cardiac assessments of high school participants in
8	8	extracurricular athletic activities sponsored or sanctioned by the
9	9	University Interscholastic League.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Subchapter D, Chapter 33, Education Code, is
12	12	amended by adding Section 33.096 to read as follows:
13	13	Sec. 33.096. CARDIAC ASSESSMENTS OF HIGH SCHOOL
14	14	PARTICIPANTS IN EXTRACURRICULAR ATHLETIC ACTIVITIES. (a) A school
15	15	district must require a district student who is required under
16	16	University Interscholastic League rule or policy to receive a
17	17	physical examination before being allowed to participate in an
18	18	athletic activity sponsored or sanctioned by the University
19	19	Interscholastic League to also have administered to the student an
20	20	electrocardiogram or echocardiogram before being allowed to
21	21	participate in the activity, including a practice for the activity,
22	22	as follows:
23	23	(1) one time before the student's first year of
24	24	participation at the ninth grade level or above; and
25	25	(2) if 11th grade is not the student's first year of
26	26	participation, another time before the student's subsequent year of
27	27	participation at the 11th grade level.
28	28	(b) This section does not create a cause of action or
29	29	liability against an appropriately licensed or certified health
30	30	care professional, a school district, or a district officer or
31	31	employee for the injury or death of a student participating in or
32	32	practicing for an athletic activity sponsored or sanctioned by the
33	33	University Interscholastic League based on or in connection with
34	34	the administration or evaluation of or reliance on an
35	35	electrocardiogram or on an echocardiogram.
36	36	(c) To facilitate the administration of electrocardiograms
37	37	or echocardiograms to students, a school district may:
38	38	(1) at the district's expense, partner with a
39	39	nonprofit entity to provide electrocardiograms or echocardiograms;
40	40	or
41	41	(2) elect to pay for the costs of administering
42	42	electrocardiograms or echocardiograms to students.
43	43	(d) The University Interscholastic League shall adopt rules
44	44	as necessary to administer this section.
45	45	(e) The rules adopted under Subsection (d) must include:
46	46	(1) criteria under which a school district may
47	47	demonstrate a hardship that allows the district to delay
48	48	administering required electrocardiograms or echocardiograms to
49	49	students under this section; and
50	50	(2) procedures that provide for granting a waiver from
51	51	administration of an electrocardiogram or echocardiogram to a
52	52	student if, for any reason, the parent or person standing in
53	53	parental relation to the student submits a written request for the
54	54	waiver.
55	55	SECTION 2. This Act applies beginning with the 2019-2020
56	56	school year.
57	57	SECTION 3. This Act takes effect immediately if it receives
58	58	a vote of two-thirds of all the members elected to each house, as
59	59	provided by Section 39, Article III, Texas Constitution. If this
60	60	Act does not receive the vote necessary for immediate effect, this
61	61	Act takes effect September 1, 2019.
