66 AN ACT
77 relating to cardiac assessments of high school participants in
88 extracurricular athletic activities sponsored or sanctioned by the
99 University Interscholastic League.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 33, Education Code, is
1212 amended by adding Section 33.096 to read as follows:
1313 Sec. 33.096. CARDIAC ASSESSMENTS OF HIGH SCHOOL
1414 PARTICIPANTS IN EXTRACURRICULAR ATHLETIC ACTIVITIES. (a) A school
1515 district must require a district student who is required under
1616 University Interscholastic League rule or policy to receive a
1717 physical examination before being allowed to participate in an
1818 athletic activity sponsored or sanctioned by the University
1919 Interscholastic League to also have administered to the student an
2020 electrocardiogram or echocardiogram before being allowed to
2121 participate in the activity, including a practice for the activity,
2222 as follows:
2323 (1) one time before the student's first year of
2424 participation at the ninth grade level or above; and
2525 (2) if 11th grade is not the student's first year of
2626 participation, another time before the student's subsequent year of
2727 participation at the 11th grade level.
2828 (b) This section does not create a cause of action or
2929 liability against an appropriately licensed or certified health
3030 care professional, a school district, or a district officer or
3131 employee for the injury or death of a student participating in or
3232 practicing for an athletic activity sponsored or sanctioned by the
3333 University Interscholastic League based on or in connection with
3434 the administration or evaluation of or reliance on an
3535 electrocardiogram or on an echocardiogram.
3636 (c) To facilitate the administration of electrocardiograms
3737 or echocardiograms to students, a school district may:
3838 (1) at the district's expense, partner with a
3939 nonprofit entity to provide electrocardiograms or echocardiograms;
4040 or
4141 (2) elect to pay for the costs of administering
4242 electrocardiograms or echocardiograms to students.
4343 (d) The University Interscholastic League shall adopt rules
4444 as necessary to administer this section.
4545 (e) The rules adopted under Subsection (d) must include:
4646 (1) criteria under which a school district may
4747 demonstrate a hardship that allows the district to delay
4848 administering required electrocardiograms or echocardiograms to
4949 students under this section; and
5050 (2) procedures that provide for granting a waiver from
5151 administration of an electrocardiogram or echocardiogram to a
5252 student if, for any reason, the parent or person standing in
5353 parental relation to the student submits a written request for the
5454 waiver.
5555 SECTION 2. This Act applies beginning with the 2019-2020
5656 school year.
5757 SECTION 3. This Act takes effect immediately if it receives
5858 a vote of two-thirds of all the members elected to each house, as
5959 provided by Section 39, Article III, Texas Constitution. If this
6060 Act does not receive the vote necessary for immediate effect, this
6161 Act takes effect September 1, 2019.
