55 AN ACT
66 relating to the eligibility of property used for a water
77 desalination project for ad valorem tax benefits under the Texas
88 Economic Development Act.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 313.024(b), Tax Code, is amended to read
1111 as follows:
1212 (b) To be eligible for a limitation on appraised value under
1313 this subchapter, the entity must use the property for:
1414 (1) manufacturing;
1515 (2) research and development;
1616 (3) a clean coal project, as defined by Section 5.001,
1717 Water Code;
1818 (4) an advanced clean energy project, as defined by
1919 Section 382.003, Health and Safety Code;
2020 (5) renewable energy electric generation;
2121 (6) electric power generation using integrated
2222 gasification combined cycle technology;
2323 (7) nuclear electric power generation;
2424 (8) a computer center primarily used in connection
2525 with one or more activities described by Subdivisions (1) through
2626 (7) conducted by the entity; [or]
2727 (9) a Texas priority project; or
2828 (10) a water desalination project.
2929 SECTION 2. Section 313.024(e), Tax Code, is amended by
3030 adding Subdivision (10) to read as follows:
3131 (10) "Water desalination" means the removal of the
3232 inorganic and organic dissolved constituents or total dissolved
3333 solids content of saline, brackish, or impaired water, including
3434 water produced in oil or gas drilling, completion, flowback, or
3535 production, to produce fresh water of usable quality for public,
3636 agricultural, industrial, environmental, or other beneficial uses.
3737 SECTION 3. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2019.
