66 AN ACT
77 relating to the creation of an adaptive sports program by the
88 University Interscholastic League to provide students with
99 disabilities access to team sports.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 33, Education Code, is
1212 amended by adding Section 33.097 to read as follows:
1313 Sec. 33.097. ADAPTIVE SPORTS PROGRAM FOR STUDENTS WITH
1414 DISABILITIES. (a) The University Interscholastic League shall
1515 ensure students with disabilities have an opportunity to
1616 participate in team athletic activities by establishing an adaptive
1717 sports program. In establishing the adaptive sports program, the
1818 league shall consider and incorporate as appropriate:
1919 (1) federal guidance regarding providing access to
2020 extracurricular athletics for students with disabilities;
2121 (2) guidance available from nationally recognized
2222 organizations that provide or promote adaptive athletics;
2323 (3) information regarding adaptive sports programs
2424 that have been successfully implemented in other states or by
2525 nonprofit organizations; and
2626 (4) input from school districts and the agency.
2727 (b) In establishing the adaptive sports program, the
2828 University Interscholastic League shall, to the greatest extent
2929 possible, require:
3030 (1) students who participate in the program to be
3131 subject to the same rules and requirements as students who
3232 participate in other athletic programs offered by the league,
3333 including:
3434 (A) grade and disciplinary requirements under
3535 Section 33.081(c); and
3636 (B) requirements related to student safety in
3737 athletic activities under this chapter and Chapter 38; and
3838 (2) team sports provided through the program to be
3939 organized similarly to other athletic programs offered by the
4040 league, including with respect to team practices, seasonal play,
4141 and local and statewide competitions.
4242 (c) In addition to using funds appropriated for the purpose,
4343 the University Interscholastic League may seek and accept gifts,
4444 grants, or donations of money from public and private sources for
4545 the purpose of establishing or expanding the adaptive sports
4646 program.
4747 (d) The University Interscholastic League shall adopt rules
4848 as necessary to establish, maintain, and expand the adaptive sports
4949 program. The rules must:
5050 (1) require that team sports offered through the
5151 program be available to students at public middle schools, junior
5252 high schools, and high schools in the state;
5353 (2) establish eligibility requirements for
5454 participation in each team sport offered through the program; and
5555 (3) identify best practices for school districts to
5656 incorporate adaptive sports.
5757 SECTION 2. This Act takes effect September 1, 2019.
